2020 pilot program; and (2) recommendations of the department, the

4141 A BILL FOR AN ACT to amend the Indiana Code concerning
4242 public safety and to make an appropriation.
4343 Be it enacted by the General Assembly of the State of Indiana:
4444 1 SECTION 1. IC 10-19-13 IS ADDED TO THE INDIANA CODE
4545 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE

4747 4 Chapter 13. PFAS Biomonitoring Pilot Program
4848 5 Sec. 1. As used in this chapter, "fund" means the PFAS
4949 6 biomonitoring pilot fund established by section 13 of this chapter.
5050 7 Sec. 2. As used in this chapter, "PFAS chemical" has the
5151 8 meaning set forth in IC 36-8-10.7-3.
5252 9 Sec. 3. As used in this chapter, "pilot program" means the PFAS
5353 10 biomonitoring pilot program established under section 5 of this
5454 11 chapter.
5555 12 Sec. 4. As used in this chapter, "serum PFAS levels" means the
5656 13 level of PFAS chemicals in an individual's blood.
5757 14 Sec. 5. The department shall establish the PFAS biomonitoring
5858 15 pilot program for the following purposes:
5959 16 (1) To collect blood samples from individuals described in
6060 17 section 6 of this chapter for the purposes of measuring serum

6262 1 PFAS levels.
6363 2 (2) To determine, to the extent possible, whether there are any
6464 3 health implications that may be attributed to elevated serum
6565 4 PFAS levels.
6666 5 (3) To identify regions of the state where individuals described
6767 6 in section 6 of this chapter may experience exposure to PFAS
6868 7 chemicals in higher concentrations.
6969 8 Sec. 6. Subject to section 7 of this chapter, the department shall
7070 9 approve an individual to participate in the pilot program if the
7171 10 following conditions are met:
7272 11 (1) The individual was previously employed, or is currently
7373 12 employed, as a firefighter.
7474 13 (2) The individual applies to participate in the pilot program
7575 14 in a form and manner prescribed by the department.
7676 15 Sec. 7. (a) The department shall, to the extent possible, test one
7777 16 thousand (1,000) individuals described in section 6 of this chapter.
7878 17 (b) If there is additional money in the fund at the end of the state
7979 18 fiscal year, the department may test additional individuals
8080 19 described in section 6 of this chapter.
8181 20 Sec. 8. The department shall do the following:
8282 21 (1) Administer the pilot program.
8383 22 (2) Consult with the department of environmental
8484 23 management and the Indiana department of health regarding
8585 24 the data and findings from the pilot program for the purpose
8686 25 of establishing recommendations regarding reducing serum
8787 26 PFAS levels and exposure to PFAS chemicals.
8888 27 (3) Develop and implement a plan for outreach to recruit
8989 28 individuals described in section 6 of this chapter to participate
9090 29 in the pilot program.
9191 30 (4) At the request of an individual described in section 6 of
9292 31 this chapter, collect and analyze blood samples to determine
9393 32 serum PFAS levels.
9494 33 (5) Develop and issue a questionnaire and medical release
9595 34 form for an individual described in section 6 of this chapter.
9696 35 Sec. 9. The department may contract with a third party to
9797 36 administer the pilot program and to store data collected under the
9898 37 pilot program under this chapter.
9999 38 Sec. 10. The department may not disclose for public inspection
100100 39 or copy the name, address, telephone number, or any other
101101 40 identifying information relating to an individual described in
102102 41 section 6 of this chapter as contained in data collected by the pilot
103103 42 program.

105105 1 Sec. 11. The department shall apply for federal funds:
106106 2 (1) available to aid in the administration of the pilot program;
107107 3 and
108108 4 (2) for which the state may be eligible.
109109 5 Sec. 12. (a) Not later than July 1, 2027, the department shall
110110 6 prepare and submit a report that includes:
111111 7 (1) a summary of the results of and conclusions from the pilot
112112 8 program; and
113113 9 (2) any recommendations of the department, the department
114114 10 of environmental management, and the Indiana department
115115 11 of health for reducing serum PFAS levels and exposure to
116116 12 PFAS chemicals;
117117 13 to the governor and legislative council. A report to the legislative
118118 14 council must be in an electronic format under IC 5-14-6.
119119 15 (b) The report submitted under subsection (a) may not contain
120120 16 identifying information relating to an individual described in
121121 17 section 6 of this chapter.
122122 18 (c) Except as otherwise provided in this chapter, data collected
123123 19 and analyzed for the pilot program is confidential and may not be
124124 20 disclosed by the department.
125125 21 Sec. 13. (a) The PFAS biomonitoring pilot fund is established for
126126 22 the purpose of providing funding for the pilot program. The fund
127127 23 shall be administered by the department.
128128 24 (b) The expenses of administering the fund shall be paid from
129129 25 the money in the fund.
130130 26 (c) The treasurer of state shall invest money in the fund not
131131 27 currently needed to meet the obligations of the fund in the same
132132 28 manner as other public money may be invested. Interest that
133133 29 accrues from these investments shall be deposited in the fund.
134134 30 (d) Money in the fund consists of appropriations, gifts, grants,
135135 31 and donations from public or private sources.
136136 32 (e) Money in the fund at the end of the state fiscal year does not
137137 33 revert to the state general fund. However, any appropriated money
138138 34 remaining in the fund on June 30, 2028, reverts to the state general
139139 35 fund.
140140 36 (f) There is appropriated to the fund two hundred thousand
141141 37 dollars ($200,000) from the state general fund for the purpose of
142142 38 administering the pilot program under this chapter.
143143 39 Sec. 14. This chapter expires July 1, 2028.
