Synopsis:  PFAS biomonitoring pilot program. Establishes the PFAS
biomonitoring pilot program (pilot program) under the department of
homeland security (department) to collect and analyze blood samples
of individuals who were previously, or are currently, firefighters: (1)
for serum PFAS levels; and (2) to determine whether there may be
corresponding health implications associated with elevated serum
PFAS levels. Requires the department to consult the department of
environmental management and the Indiana department of health
regarding the pilot program. Provides that the department shall, to the
extent possible, test 1,000 firefighters. Allows the department to work
with a third party to administer the pilot program and to store data
collected under the pilot program. Requires the department to submit,
not later than July 1, 2027, a report summarizing: (1) the results of the
pilot program; and (2) recommendations of the department, the
department of environmental management, and the Indiana department
of health for decreasing serum PFAS levels and exposure to PFAS
chemicals; to the governor and the legislative council. Establishes the
PFAS biomonitoring pilot fund. Makes an appropriation.

SENATE BILL No. 482
A BILL FOR AN ACT to amend the Indiana Code concerning
public safety and to make an appropriation.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 10-19-13 IS ADDED TO THE INDIANA CODE
2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2023]:
4 Chapter 13. PFAS Biomonitoring Pilot Program
5 Sec. 1. As used in this chapter, "fund" means the PFAS
6 biomonitoring pilot fund established by section 13 of this chapter.
7 Sec. 2. As used in this chapter, "PFAS chemical" has the
8 meaning set forth in IC 36-8-10.7-3.
9 Sec. 3. As used in this chapter, "pilot program" means the PFAS
10 biomonitoring pilot program established under section 5 of this
11 chapter.
12 Sec. 4. As used in this chapter, "serum PFAS levels" means the
13 level of PFAS chemicals in an individual's blood.
14 Sec. 5. The department shall establish the PFAS biomonitoring
15 pilot program for the following purposes:
16 (1) To collect blood samples from individuals described in
17 section 6 of this chapter for the purposes of measuring serum

1 PFAS levels.
2 (2) To determine, to the extent possible, whether there are any
3 health implications that may be attributed to elevated serum
4 PFAS levels.
5 (3) To identify regions of the state where individuals described
6 in section 6 of this chapter may experience exposure to PFAS
7 chemicals in higher concentrations.
8 Sec. 6. Subject to section 7 of this chapter, the department shall
9 approve an individual to participate in the pilot program if the
10 following conditions are met:
11 (1) The individual was previously employed, or is currently
12 employed, as a firefighter.
13 (2) The individual applies to participate in the pilot program
14 in a form and manner prescribed by the department.
15 Sec. 7. (a) The department shall, to the extent possible, test one
16 thousand (1,000) individuals described in section 6 of this chapter.
17 (b) If there is additional money in the fund at the end of the state
18 fiscal year, the department may test additional individuals
19 described in section 6 of this chapter.
20 Sec. 8. The department shall do the following:
21 (1) Administer the pilot program.
22 (2) Consult with the department of environmental
23 management and the Indiana department of health regarding
24 the data and findings from the pilot program for the purpose
25 of establishing recommendations regarding reducing serum
26 PFAS levels and exposure to PFAS chemicals.
27 (3) Develop and implement a plan for outreach to recruit
28 individuals described in section 6 of this chapter to participate
29 in the pilot program.
30 (4) At the request of an individual described in section 6 of
31 this chapter, collect and analyze blood samples to determine
32 serum PFAS levels.
33 (5) Develop and issue a questionnaire and medical release
34 form for an individual described in section 6 of this chapter.
35 Sec. 9. The department may contract with a third party to
36 administer the pilot program and to store data collected under the
37 pilot program under this chapter.
38 Sec. 10. The department may not disclose for public inspection
39 or copy the name, address, telephone number, or any other
40 identifying information relating to an individual described in
41 section 6 of this chapter as contained in data collected by the pilot
42 program.

1 Sec. 11. The department shall apply for federal funds:
2 (1) available to aid in the administration of the pilot program;
3 and
4 (2) for which the state may be eligible.
5 Sec. 12. (a) Not later than July 1, 2027, the department shall
6 prepare and submit a report that includes:
7 (1) a summary of the results of and conclusions from the pilot
8 program; and
9 (2) any recommendations of the department, the department
10 of environmental management, and the Indiana department
11 of health for reducing serum PFAS levels and exposure to
12 PFAS chemicals;
13 to the governor and legislative council. A report to the legislative
14 council must be in an electronic format under IC 5-14-6.
15 (b) The report submitted under subsection (a) may not contain
16 identifying information relating to an individual described in
17 section 6 of this chapter.
18 (c) Except as otherwise provided in this chapter, data collected
19 and analyzed for the pilot program is confidential and may not be
20 disclosed by the department.
21 Sec. 13. (a) The PFAS biomonitoring pilot fund is established for
22 the purpose of providing funding for the pilot program. The fund
23 shall be administered by the department.
24 (b) The expenses of administering the fund shall be paid from
25 the money in the fund.
26 (c) The treasurer of state shall invest money in the fund not
27 currently needed to meet the obligations of the fund in the same
28 manner as other public money may be invested. Interest that
29 accrues from these investments shall be deposited in the fund.
30 (d) Money in the fund consists of appropriations, gifts, grants,
31 and donations from public or private sources.
32 (e) Money in the fund at the end of the state fiscal year does not
33 revert to the state general fund. However, any appropriated money
34 remaining in the fund on June 30, 2028, reverts to the state general
35 fund.
36 (f) There is appropriated to the fund two hundred thousand
37 dollars ($200,000) from the state general fund for the purpose of
38 administering the pilot program under this chapter.
39 Sec. 14. This chapter expires July 1, 2028.
