2318 1 A CONCURRENT RESOLUTION directing the Indiana
2419 2 State Police to convene a working group to study Rapid
2520 3 Deoxyribonucleic Acid (DNA) and provide a report with
2621 4 findings and recommendations to the Legislative Council before
2722 5 December 15, 2023.
2823 6 Whereas, Rapid DNA analysis is a relatively new
2924 7 technology where a DNA profile can be developed in less than
3025 8 two hours from a mouth swab through the use of a fully
3126 9 automated instrument without human intervention or
3227 10 interpretations;
3328 11 Whereas, Since 2010, Rapid DNA has been shown to
3429 12 dramatically impact law enforcement's ability to generate
3530 13 investigative leads while an arrestee is still in custody by
3631 14 enrolling a qualified arrestee's DNA profile into the Combined
3732 15 DNA Index System, also known as "CODIS", during the
3833 16 booking process and cross-searching the arrestee's information
3934 17 within the CODIS database;
4035 18 Whereas, CODIS is a computer software program
4136 19 maintained by the Federal Bureau of Investigation ("FBI") that
4237 20 allows state and local crime laboratories to store and compare
4338 21 evidence from convicted offenders, unsolved crime scene
4439 22 evidence, and missing persons to help solve crimes;
4540 23 Whereas, The federal Rapid DNA Act of 2017allows state
4641 24 CODIS agencies to establish Rapid DNA programs within their
4742 25 state in conjunction with the FBI so that Rapid DNA profiles
4843 26 can be uploaded to CODIS;

5045 1 Whereas, Currently there are multiple local and state law
5146 2 enforcement agencies exploring the use of Rapid DNA
5247 3 technology;
5348 4 Whereas, It would be beneficial for the Indiana State Police
5449 5 to study Rapid DNA to determine the estimated cost of Rapid
5550 6 DNA instruments and analysis supplies, the time and staff
5651 7 resources that would be necessary for implementation, when
5752 8 the process may be used, and what technology infrastructure is
5853 9 required to connect Rapid DNA instruments to state and
5954 10 national databases to solve crimes;
6055 11 Whereas, Implementing a Rapid DNA program in Indiana
6156 12 has the potential to help solve numerous unsolved crimes,
6257 13 improve the administration of justice in Indiana, and bring
6358 14 closure to Hoosier families; and
6459 15 Whereas, The Indiana General Assembly directs the
6560 16 Indiana State Police to convene a working group to study the
6661 17 use of Rapid DNA in booking stations in Indiana, so that
6762 18 arrestees' DNA profiles can be compared to unsolved crimes,
6863 19 and to prepare a report with recommendations for possible
6964 20 legislation to the Legislative Council before December 15,
7065 21 2023: Therefore,
7166 22 Be it resolved by the Senate of the General Assembly
7267 23 of the State of Indiana, the House of Representatives
7368 24 concurring:
7469 25 SECTION 1. That the Indiana General Assembly directs the
7570 26 Indiana State Police to convene a working group to study and
7671 27 prepare a report with findings and recommendations regarding
7772 28 the use, cost, resources, and infrastructure needed for the Rapid
7873 29 DNA program within the State of Indiana to the Legislative
7974 30 Council by December 15, 2023.
8075 31 SECTION 2. The Indiana General Assembly directs the
8176 32 Indiana State Police to include representatives from the Indiana
8277 33 State Police Laboratory, the CODIS State Administrator, the
8378 34 Indiana Sheriffs Association, the Indiana Association of Chief
8479 35 of Police, the Indiana Prosecuting Attorneys Council, the

8681 1 Indiana Public Defender Council, and the Indiana Office of
8782 2 Technology or another information technology expert that is
8883 3 familiar with criminal justice communication systems in the
8984 4 working group.
9085 5 SECTION 3. The Secretary of the Senate is hereby directed
9186 6 to transmit a copy of this Resolution to the Indiana State Police
9287 7 and Indiana State Police Superintendent Doug Carter.

9590 Madam President: The Senate Committee on Homeland Security
9691 and Transportation, to which was referred Senate Concurrent
9792 Resolution No. 34, has had the same under consideration and begs
