SC 34—RC 1529/DI NW April 27, 2023 First Regular Session 123rd General Assembly (2023) SENATE CONCURRENT RESOLUTION No. 34 1 A CONCURRENT RESOLUTION directing the Indiana 2 State Police to convene a working group to study Rapid 3 Deoxyribonucleic Acid (DNA) and provide a report with 4 findings and recommendations to the Legislative Council before 5 December 15, 2023. 6 Whereas, Rapid DNA analysis is a relatively new 7 technology where a DNA profile can be developed in less than 8 two hours from a mouth swab through the use of a fully 9 automated instrument without human intervention or 10 interpretations; 11 Whereas, Since 2010, Rapid DNA has been shown to 12 dramatically impact law enforcement's ability to generate 13 investigative leads while an arrestee is still in custody by 14 enrolling a qualified arrestee's DNA profile into the Combined 15 DNA Index System, also known as "CODIS", during the 16 booking process and cross-searching the arrestee's information 17 within the CODIS database; 18 Whereas, CODIS is a computer software program 19 maintained by the Federal Bureau of Investigation ("FBI") that 20 allows state and local crime laboratories to store and compare 21 evidence from convicted offenders, unsolved crime scene 22 evidence, and missing persons to help solve crimes; 23 Whereas, The federal Rapid DNA Act of 2017allows state 24 CODIS agencies to establish Rapid DNA programs within their 25 state in conjunction with the FBI so that Rapid DNA profiles 26 can be uploaded to CODIS; SC 34—RC 1529/DI NW 2 1 Whereas, Currently there are multiple local and state law 2 enforcement agencies exploring the use of Rapid DNA 3 technology; 4 Whereas, It would be beneficial for the Indiana State Police 5 to study Rapid DNA to determine the estimated cost of Rapid 6 DNA instruments and analysis supplies, the time and staff 7 resources that would be necessary for implementation, when 8 the process may be used, and what technology infrastructure is 9 required to connect Rapid DNA instruments to state and 10 national databases to solve crimes; 11 Whereas, Implementing a Rapid DNA program in Indiana 12 has the potential to help solve numerous unsolved crimes, 13 improve the administration of justice in Indiana, and bring 14 closure to Hoosier families; and 15 Whereas, The Indiana General Assembly directs the 16 Indiana State Police to convene a working group to study the 17 use of Rapid DNA in booking stations in Indiana, so that 18 arrestees' DNA profiles can be compared to unsolved crimes, 19 and to prepare a report with recommendations for possible 20 legislation to the Legislative Council before December 15, 21 2023: Therefore, 22 Be it resolved by the Senate of the General Assembly 23 of the State of Indiana, the House of Representatives 24 concurring: 25 SECTION 1. That the Indiana General Assembly directs the 26 Indiana State Police to convene a working group to study and 27 prepare a report with findings and recommendations regarding 28 the use, cost, resources, and infrastructure needed for the Rapid 29 DNA program within the State of Indiana to the Legislative 30 Council by December 15, 2023. 31 SECTION 2. The Indiana General Assembly directs the 32 Indiana State Police to include representatives from the Indiana 33 State Police Laboratory, the CODIS State Administrator, the 34 Indiana Sheriffs Association, the Indiana Association of Chief 35 of Police, the Indiana Prosecuting Attorneys Council, the SC 34—RC 1529/DI NW 3 1 Indiana Public Defender Council, and the Indiana Office of 2 Technology or another information technology expert that is 3 familiar with criminal justice communication systems in the 4 working group. 5 SECTION 3. The Secretary of the Senate is hereby directed 6 to transmit a copy of this Resolution to the Indiana State Police 7 and Indiana State Police Superintendent Doug Carter.
