29	29	A BILL FOR AN ACT to amend the Indiana Code concerning
30	30	health.
31	31	Be it enacted by the General Assembly of the State of Indiana:
32	32	1 SECTION 1. IC 16-41-18.7 IS ADDED TO THE INDIANA CODE
33	33	2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
34	34	3 JULY 1, 2024]:
35	35	4 Chapter 18.7. Cytomegalovirus Education
36	36	5 Sec. 1. (a) The state department shall establish and administer
37	37	6 a public education program to provide information on
38	38	7 cytomegalovirus to pregnant women.
39	39	8 (b) The program must include information on the following:
40	40	9 (1) The incidence of cytomegalovirus.
41	41	10 (2) Transmission of cytomegalovirus to pregnant women and
42	42	11 women who may become pregnant.
43	43	12 (3) Birth defects caused by congenital cytomegalovirus.
44	44	13 (4) Diagnosis of congenital cytomegalovirus.
45	45	14 (5) Prevention of cytomegalovirus.
46	46	15 Sec. 2. (a) The state department shall distribute the information
47	47	16 described in section 1(b) of this chapter to the following:
48	48	17 (1) Each operator and employee of a:

50	50	1 (A) child care home licensed under IC 12-17.2-5;
51	51	2 (B) child care center licensed under IC 12-17.2-4; and
52	52	3 (C) child care ministry registered under IC 12-17.2-6.
53	53	4 (2) Each health care provider that offers care to pregnant
54	54	5 women and infants.
55	55	6 (3) Each clinic or medical facility in Indiana that offers
56	56	7 fertility care.
57	57	8 (4) Each local fetal-infant mortality review team established
58	58	9 under IC 16-49-6.
59	59	10 (b) A clinic or medical facility described in subsection (a)(3)
60	60	11 shall make the information concerning cytomegalovirus available
61	61	12 to each patient of the clinic or facility.
