2929 A BILL FOR AN ACT to amend the Indiana Code concerning

3131 Be it enacted by the General Assembly of the State of Indiana:
3232 1 SECTION 1. IC 16-41-18.7 IS ADDED TO THE INDIANA CODE
3333 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
3434 3 JULY 1, 2024]:
3535 4 Chapter 18.7. Cytomegalovirus Education
3636 5 Sec. 1. (a) The state department shall establish and administer
3737 6 a public education program to provide information on
3838 7 cytomegalovirus to pregnant women.
3939 8 (b) The program must include information on the following:
4040 9 (1) The incidence of cytomegalovirus.
4141 10 (2) Transmission of cytomegalovirus to pregnant women and
4242 11 women who may become pregnant.
4343 12 (3) Birth defects caused by congenital cytomegalovirus.
4444 13 (4) Diagnosis of congenital cytomegalovirus.
4545 14 (5) Prevention of cytomegalovirus.
4646 15 Sec. 2. (a) The state department shall distribute the information
4747 16 described in section 1(b) of this chapter to the following:
4848 17 (1) Each operator and employee of a:

5050 1 (A) child care home licensed under IC 12-17.2-5;
5151 2 (B) child care center licensed under IC 12-17.2-4; and
5252 3 (C) child care ministry registered under IC 12-17.2-6.
5353 4 (2) Each health care provider that offers care to pregnant
5454 5 women and infants.
5555 6 (3) Each clinic or medical facility in Indiana that offers
5656 7 fertility care.
5757 8 (4) Each local fetal-infant mortality review team established
5858 9 under IC 16-49-6.
5959 10 (b) A clinic or medical facility described in subsection (a)(3)
6060 11 shall make the information concerning cytomegalovirus available
6161 12 to each patient of the clinic or facility.
