Citations Affected:  IC 16-41-18.7.
Synopsis:  Information concerning cytomegalovirus infection. Requires
the Indiana department of health to: (1) establish and administer a
public education program to provide information on cytomegalovirus
to pregnant women; and (2) distribute the information to specified
persons. Requires a clinic or medical facility that offers fertility care to
make the information concerning cytomegalovirus available to patients
of the clinic or facility.
Effective:  July 1, 2024.

HOUSE BILL No. 1110
A BILL FOR AN ACT to amend the Indiana Code concerning
health.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 16-41-18.7 IS ADDED TO THE INDIANA CODE
2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2024]:
4 Chapter 18.7. Cytomegalovirus Education
5 Sec. 1. (a) The state department shall establish and administer
6 a public education program to provide information on
7 cytomegalovirus to pregnant women.
8 (b) The program must include information on the following:
9 (1) The incidence of cytomegalovirus.
10 (2) Transmission of cytomegalovirus to pregnant women and
11 women who may become pregnant.
12 (3) Birth defects caused by congenital cytomegalovirus.
13 (4) Diagnosis of congenital cytomegalovirus.
14 (5) Prevention of cytomegalovirus.
15 Sec. 2. (a) The state department shall distribute the information
16 described in section 1(b) of this chapter to the following:
17 (1) Each operator and employee of a:

1 (A) child care home licensed under IC 12-17.2-5;
2 (B) child care center licensed under IC 12-17.2-4; and
3 (C) child care ministry registered under IC 12-17.2-6.
4 (2) Each health care provider that offers care to pregnant
5 women and infants.
6 (3) Each clinic or medical facility in Indiana that offers
7 fertility care.
8 (4) Each local fetal-infant mortality review team established
9 under IC 16-49-6.
10 (b) A clinic or medical facility described in subsection (a)(3)
11 shall make the information concerning cytomegalovirus available
12 to each patient of the clinic or facility.
