2727 A BILL FOR AN ACT to amend the Indiana Code concerning
2828 public safety.
2929 Be it enacted by the General Assembly of the State of Indiana:
3030 1 SECTION 1. IC 10-17-12-10, AS AMENDED BY P.L.53-2021,
3131 2 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3232 3 JULY 1, 2024]: Sec. 10. (a) The commission shall adopt rules under
3333 4 IC 4-22-2 for the provision of grants under this chapter. Subject to
3434 5 subsection (b), the rules adopted under this section must address the
3535 6 following:
3636 7 (1) Uniform need determination procedures.
3737 8 (2) Eligibility criteria, including income eligibility standards,
3838 9 asset limit eligibility standards, and other standards concerning
3939 10 when assistance may be provided. which shall be based on the
4040 11 financial need of the applicant regardless of the applicant's
4141 12 income or assets.
4242 13 (3) Application procedures.
4343 14 (4) Selection procedures.
4444 15 (5) A consideration of the extent to which an individual has used
4545 16 assistance available from other assistance programs before
4646 17 assistance may be provided to the individual from the fund.

4848 1 (6) Other areas in which the commission determines that rules are
4949 2 necessary to ensure the uniform administration of the grant
5050 3 program under this chapter.
5151 4 (b) The following apply to grants awarded under this chapter:
5252 5 (1) The income eligibility standards must be based on the federal
5353 6 gross income of the qualified service member and the qualified
5454 7 service member's spouse.
5555 8 (2) (1) An employee of the department who is otherwise eligible
5656 9 for a grant from the fund must submit the employee's application
5757 10 directly to the commission for review. The department shall have
5858 11 no influence in any part of the employee's application.
5959 12 (3) (2) The maximum amount a qualified service member may
6060 13 receive from the fund is two thousand five hundred dollars
6161 14 ($2,500), unless a higher amount is approved by the commission.
6262 15 (4) (3) The commission may consider the following in its analysis
6363 16 of the applicant's request for assistance in excess of two thousand
6464 17 five hundred dollars ($2,500):
6565 18 (A) The department's eligibility determination of the applicant.
6666 19 (B) Subject to subsection (a)(2), facts considered in the
6767 20 department's need determination review and award under 915
6868 21 IAC 3-6-3 and 915 IAC 3-6-5.
6969 22 (C) The circumstances surrounding the applicant's hardship,
7070 23 if applicable.
7171 24 (D) Subject to subsection (a)(2), any substantive changes in
7272 25 the applicant's financial situation after the original application
7373 26 was submitted.
7474 27 (E) Facts that may have been unknown or unavailable at the
7575 28 time of the applicant's original application for assistance.
7676 29 (F) Other compelling circumstances that may justify assistance
7777 30 in excess of the two thousand five hundred dollar ($2,500)
7878 31 threshold.
7979 32 (5) (4) The commission shall approve or deny within sixty (60)
8080 33 days an application for a grant filed with the commission after
8181 34 June 30, 2019, by an employee of the department. The
8282 35 commission shall return an incomplete application with a notation
8383 36 as to omissions. The return of an incomplete application shall be
8484 37 without prejudice.
