Summary of Legislation: The bill provides that the commissioner of the Department of Environmental
Management (IDEM) may, not later than 10 days after the last day of a public comment period, decide to
hold a public hearing or meeting before the issuance or denial of a permit. It requires IDEM to provide notice
if a public hearing or meeting will be held.
Effective Date: July 1, 2024.
Explanation of State Expenditures: The bill gives the IDEM commissioner until 10 days after the last day
of a public comment period to decide to hold a public hearing or meeting regarding the issuance or denial
of a permit, based on information received during the public comment period. If IDEM is not currently
making the determination within that time frame, the agency may have to modify how it makes that decision.
This is within the agency’s routine administrative functions.
