Koch FUNDS AFFECTED: GENERAL IMPACT: State XDEDICATED FEDERAL Summary of Legislation: This bill exempts the Indiana Utility Regulatory Commission (IURC) from providing a live transmission of hearings, regarding which a stenographic record is required to be made and kept by statute. It adds language to the chapter in the Indiana Code governing the IURC to require the IURC to provide on a publicly accessible platform a live transmission of any IURC proceeding that will include: (1) an examination of witnesses; (2) a nonprocedural discussion between one or more parties to the proceeding; (3) questions from one or more of the commissioners regarding the substance of the case; or (4) a contested procedural matter. This bill requires the IURC to issue a general administrative order to implement a policy that governs the live transmission of IURC proceedings and that includes processes: (1) by which members of the public may request and access the live transmission of an IURC proceeding; and (2) for archiving the live transmission of an IURC proceeding. Effective Date: July1, 2024; July 1, 2025. Explanation of State Expenditures: IURC: This bill’s provisions may result in a temporary increase in administrative workload for the IURC since the Commission would be required to draft and issue a general administrative order to implment a policy that governs the live transmission of Commission proceedings. Additionally, the IURC may experience a minor increase in expenditures to the extent that the Commission would have to (1) record and make accessible upon request certain hearings that do not meet the criteria HB 1306 1 specified in the Commission’s general administrative order pertaining to its proceedings that are live streamed and (2) archive and make accessible upon request at later date those hearings that were live streamed. Additional Information: According to the IURC’s website, the Commission currently streams evidentiary hearings and public meetings of general interest that are scheduled in one of their designated hearing rooms and include cross examination, discussion, or questions from the hearing officers, as well as any other hearing or meeting as determined by the IURC. Additionally, the website notes that prehearing conferences or routine cases where there is limited or no discussion are not streamed.
