Synopsis: Automated commercial motor vehicles. Provides that an
automated commercial motor vehicle may not be operated on a
highway to transport passengers or goods unless a human operator who
meets all state and federal qualifications to operate a commercial motor
vehicle is physically present in the automated commercial motor
vehicle to monitor the performance of the automated commercial motor
vehicle and to take control of all or part of the automated commercial
motor vehicle's operation, if necessary. Provides that a registered
automated commercial motor vehicle must meet federal commercial
motor vehicle standards and regulations.

A BILL FOR AN ACT to amend the Indiana Code concerning
motor vehicles.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 9-13-2-6.2 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2024]: Sec. 6.2. "Automated commercial motor vehicle" means
4 a commercial motor vehicle with respect to which at least one (1)
5 aspect of a safety critical control function of the commercial motor
6 vehicle occurs without direct input from an individual operating
7 the commercial motor vehicle.
8 SECTION 2. IC 9-13-2-31.1 IS ADDED TO THE INDIANA CODE
9 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
10 1, 2024]: Sec. 31.1. "Commercial motor vehicle operator" means
11 an individual who meets all state and federal qualifications to
12 operate a commercial motor vehicle.
13 SECTION 3. IC 9-21-8-60 IS ADDED TO THE INDIANA CODE
14 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
15 1, 2024]: Sec. 60. (a) An automated commercial motor vehicle
16 registered in Indiana must meet federal standards and regulations
17 applicable to commercial motor vehicles.

1 (b) A person may not operate an automated commercial motor
2 vehicle on a highway to transport passengers or goods unless a
3 human commercial motor vehicle operator is physically present in
4 the automated commercial motor vehicle to:
5 (1) monitor the performance of the automated commercial
6 motor vehicle; and
7 (2) if necessary, take control of all or part of the dynamic
8 driving task for the automated commercial motor vehicle.
