HOUSE ENROLLED ACT No. 1122
AN ACT to amend the Indiana Code concerning criminal law and
procedure.
Be it enacted by the General Assembly of the State of Indiana:
SECTION 1. IC 35-44.1-2-15 IS ADDED TO THE INDIANA
CODE AS A NEW SECTION TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2025]: Sec. 15. (a) A law enforcement officer:
(1) lawfully engaged in the execution of the law enforcement
officer's duties; and
(2) who reasonably believes that a person's presence within
twenty-five (25) feet of the law enforcement officer will
interfere with the performance of the law enforcement
officer's duties;
may order the person to stop approaching.
(b) A person who knowingly or intentionally approaches within
twenty-five (25) feet of a law enforcement officer lawfully engaged
in the execution of the law enforcement officer's duties after the
law enforcement officer has ordered the person to stop
approaching in accordance with subsection (a) commits unlawful
encroachment on a law enforcement officer, a Class C
misdemeanor.
