2525 A BILL FOR AN ACT to amend the Indiana Code concerning
2626 insurance.
2727 Be it enacted by the General Assembly of the State of Indiana:
2828 1 SECTION 1. IC 5-10-8-28 IS ADDED TO THE INDIANA CODE
2929 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3030 3 1, 2025]: Sec. 28. (a) This section applies to a state employee health
3131 4 plan that is established, entered into, amended, or renewed after
3232 5 June 30, 2025.
3333 6 (b) As used in this section, "anti-obesity medication" means
3434 7 medication approved by the federal Food and Drug Administration
3535 8 that is prescribed by a physician to help an individual achieve and
3636 9 maintain a healthy weight.
3737 10 (c) As used in this section, "eligible individual" means an
3838 11 individual who is:
3939 12 (1) entitled to coverage under a state employee health plan;
4040 13 and
4141 14 (2) diagnosed with obesity.
4242 15 (d) As used in this section, "intensive behavioral and lifestyle
4343 16 therapy" means counseling or treatment that focuses on:
4444 17 (1) changing an individual's lifestyle and behavioral habits,

4646 1 including nutrition and exercise support; and
4747 2 (2) managing or treating obesity.
4848 3 (e) As used in this section, "physician" means an individual
4949 4 licensed to practice medicine under IC 25-22.5.
5050 5 (f) As used in this section, "state employee health plan" means
5151 6 the following:
5252 7 (1) A self-insurance program established under section 7(b) of
5353 8 this chapter.
5454 9 (2) A contract for prepaid health care delivery plan entered
5555 10 into under section 7(c) of this chapter.
5656 11 (g) A state employee health plan shall provide coverage for:
5757 12 (1) anti-obesity medication; and
5858 13 (2) intensive behavioral and lifestyle therapy;
5959 14 for an eligible individual.
