28 | 28 | | 1 SECTION 1. IC 5-10-8-28 IS ADDED TO THE INDIANA CODE |

29 | 29 | | 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY |

30 | 30 | | 3 1, 2025]: Sec. 28. (a) This section applies to a state employee health |
---|
31 | 31 | | 4 plan that is established, entered into, amended, or renewed after |
---|
32 | 32 | | 5 June 30, 2025. |
---|
33 | 33 | | 6 (b) As used in this section, "anti-obesity medication" means |
---|
34 | 34 | | 7 medication approved by the federal Food and Drug Administration |
---|
35 | 35 | | 8 that is prescribed by a physician to help an individual achieve and |
---|
36 | 36 | | 9 maintain a healthy weight. |
---|
37 | 37 | | 10 (c) As used in this section, "eligible individual" means an |
---|
38 | 38 | | 11 individual who is: |
---|
39 | 39 | | 12 (1) entitled to coverage under a state employee health plan; |
---|
40 | 40 | | 13 and |
---|
41 | 41 | | 14 (2) diagnosed with obesity. |
---|
42 | 42 | | 15 (d) As used in this section, "intensive behavioral and lifestyle |
---|
43 | 43 | | 16 therapy" means counseling or treatment that focuses on: |
---|
44 | 44 | | 17 (1) changing an individual's lifestyle and behavioral habits, |
---|

46 | 46 | | 1 including nutrition and exercise support; and |
---|
47 | 47 | | 2 (2) managing or treating obesity. |
---|
48 | 48 | | 3 (e) As used in this section, "physician" means an individual |
---|
49 | 49 | | 4 licensed to practice medicine under IC 25-22.5. |

50 | 50 | | 5 (f) As used in this section, "state employee health plan" means |
---|
51 | 51 | | 6 the following: |
---|
52 | 52 | | 7 (1) A self-insurance program established under section 7(b) of |
---|
53 | 53 | | 8 this chapter. |
---|
54 | 54 | | 9 (2) A contract for prepaid health care delivery plan entered |
---|
55 | 55 | | 10 into under section 7(c) of this chapter. |
---|
56 | 56 | | 11 (g) A state employee health plan shall provide coverage for: |
---|
57 | 57 | | 12 (1) anti-obesity medication; and |
---|
58 | 58 | | 13 (2) intensive behavioral and lifestyle therapy; |
---|
59 | 59 | | 14 for an eligible individual. |
