HOUSE BILL No. 1138 A BILL FOR AN ACT to amend the Indiana Code concerning insurance. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 5-10-8-28 IS ADDED TO THE INDIANA CODE 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 3 1, 2025]: Sec. 28. (a) This section applies to a state employee health 4 plan that is established, entered into, amended, or renewed after 5 June 30, 2025. 6 (b) As used in this section, "anti-obesity medication" means 7 medication approved by the federal Food and Drug Administration 8 that is prescribed by a physician to help an individual achieve and 9 maintain a healthy weight. 10 (c) As used in this section, "eligible individual" means an 11 individual who is: 12 (1) entitled to coverage under a state employee health plan; 13 and 14 (2) diagnosed with obesity. 15 (d) As used in this section, "intensive behavioral and lifestyle 16 therapy" means counseling or treatment that focuses on: 17 (1) changing an individual's lifestyle and behavioral habits, 2025 IN 1138—LS 7009/DI 154 2 1 including nutrition and exercise support; and 2 (2) managing or treating obesity. 3 (e) As used in this section, "physician" means an individual 4 licensed to practice medicine under IC 25-22.5. 5 (f) As used in this section, "state employee health plan" means 6 the following: 7 (1) A self-insurance program established under section 7(b) of 8 this chapter. 9 (2) A contract for prepaid health care delivery plan entered 10 into under section 7(c) of this chapter. 11 (g) A state employee health plan shall provide coverage for: 12 (1) anti-obesity medication; and 13 (2) intensive behavioral and lifestyle therapy; 14 for an eligible individual. 2025 IN 1138—LS 7009/DI 154
