3030 A BILL FOR AN ACT to amend the Indiana Code concerning local

3232 Be it enacted by the General Assembly of the State of Indiana:
3333 1 SECTION 1. IC 36-2-13-20 IS ADDED TO THE INDIANA CODE
3434 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3535 3 1, 2025]: Sec. 20. (a) Not later than January 1, 2026, each sheriff
3636 4 with regard to a county jail shall enter into a written agreement
3737 5 with the United States Immigration and Customs Enforcement to
3838 6 participate in the immigration program established under Section
3939 7 287(g) of the Immigration and Nationality Act (8 U.S.C. 1357(g)).
4040 8 This subsection does not require a sheriff to participate in a
4141 9 particular program model.
4242 10 (b) Beginning not later than October 1, 2025, and until the
4343 11 sheriff enters into the written agreement required under subsection
4444 12 (a), each sheriff must notify the department of correction quarterly
4545 13 of the status of a written agreement described in subsection (a) and
4646 14 any reason for noncompliance with this section, if applicable.
