Synopsis:  School transportation. Provides that the governing body of
a school corporation must minimize or eliminate school bus route stops
that require a student to cross certain roads. Provides that, not later than
July 1, 2026, and annually each year thereafter, the governing body of
a school corporation shall review school bus routes to ensure the
minimization or elimination of stops that require a student to cross
certain roads.
Effective:  July 1, 2025.

HOUSE BILL No. 1164
A BILL FOR AN ACT to amend the Indiana Code concerning
education.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 9-21-12-20.5, AS AMENDED BY P.L.92-2020,
2 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2025]: Sec. 20.5. (a) As used in this section, "elementary
4 school":
5 (1) has the meaning set forth in IC 20-18-2-4; and
6 (2) includes public elementary schools and state accredited
7 nonpublic elementary schools that voluntarily become accredited
8 under IC 20-31-4.1.
9 (b) As used in this section, "governing body" has the meaning set
10 forth in IC 20-18-2-5.
11 (c) As used in this section, "high school" has the meaning set
12 forth in IC 20-18-2-7.
13 (c) (d) If a school bus driver must load or unload an elementary
14 school or high school student at a location that requires the student to
15 cross a roadway that is a U.S. route or state route as described in
16 section 20(a)(1) or 20(a)(2) of this chapter, the superintendent or the
17 superintendent's designee shall present the school bus route described

1 in this subsection to the governing body for approval.
2 (e) The governing body shall minimize or eliminate school bus
3 route stops approved under subsection (d) that require a student
4 to cross a roadway described in section 20(a)(1) or 20(a)(2) of this
5 chapter.
6 (f) Not later than July 1, 2026, and annually each year
7 thereafter, the governing body shall review any school bus routes
8 approved under subsection (d) to ensure compliance with
9 subsection (e).
