30	28		A BILL FOR AN ACT to amend the Indiana Code concerning
31	29		health and to make an appropriation.
32	30		Be it enacted by the General Assembly of the State of Indiana:
33	31		1 SECTION 1. IC 16-18-2-46.5 IS ADDED TO THE INDIANA
34	32		2 CODE AS A NEW SECTION TO READ AS FOLLOWS
35	33		3 [EFFECTIVE JULY 1, 2025]: Sec. 46.5. "Cancer center", for
36	34		4 purposes of IC 16-46-7.6, has the meaning set forth in
37	35		5 IC 16-46-7.6-1.
38	36		6 SECTION 2. IC 16-18-2-143, AS AMENDED BY P.L.1-2010,
39	37		7 SECTION 69, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
40	38		8 JULY 1, 2025]: Sec. 143. (a) "Fund", for purposes of IC 16-26-2, has

72	70		22 Chapter 7.6. Breast Cancer Research Grant Program
73	71		23 Sec. 1. As used in this chapter, "cancer center" means one (1) of
74	72		24 the following:
75	73		25 (1) An institution that has been designated by the National
76	74		26 Cancer Institute as a:
77	75		27 (A) comprehensive cancer center;
78	76		28 (B) clinical cancer center; or
79	77		29 (C) basic laboratory cancer center.
80	78		30 (2) A cancer research facility that is formally part of an
81	79		31 approved postsecondary educational institution (as defined in
82	80		32 IC 21-7-13-6(b)).
83	81		33 Sec. 2. As used in this chapter, "fund" refers to the breast
84	82		34 cancer research fund established by section 7 of this chapter.
85	83		35 Sec. 3. As used in this chapter, "program" refers to the grant
86	84		36 program established by the state department under this chapter.
87	85		37 Sec. 4. The state department shall establish a program for the
88	86		38 purpose of providing grants to cancer centers in Indiana to
89	87		39 increase:
90	88		40 (1) breast cancer research projects; or
91	89		41 (2) breast cancer clinical trials.
92	90		42 Sec. 5. The state department shall do the following:

94	92		1 (1) Develop the application criteria and standards for
95	93		2 eligibility for cancer centers that apply for grants under the
96	94		3 program.
97	95		4 (2) Make available grants to cancer centers that meet the
98	96		5 eligibility standards developed under subdivision (1).
99	97		6 However, the state department shall prioritize grants to
100	98		7 cancer centers in the following order:
101	99		8 (A) A cancer center described in section 1(1) of this
102	100		9 chapter.
103	101		10 (B) A cancer center described in section 1(2) of this
104	102		11 chapter.
105	103		12 (3) Determine the maximum amount available for each grant.
106	104		13 (4) Determine policies for the expiration and renewal of
107	105		14 grants.
108	106		15 (5) Require that each grant be used for the purpose of breast
109	107		16 cancer research.
110	108		17 (6) Adopt rules under IC 4-22-2 necessary to implement this
111	109		18 chapter.
112	110		19 Sec. 6. The state department shall administer the program.
113	111		20 Sec. 7. (a) The breast cancer research fund is established for the
114	112		21 purpose of carrying out this chapter. The state department shall
115	113		22 administer the fund.
116	114		23 (b) The fund consists of the following:
117	115		24 (1) Appropriations from the general assembly.
118	116		25 (2) Amounts, if any, distributed to the fund from the Indiana
119	117		26 tobacco master settlement agreement fund.
120	118		27 (3) Gifts, bequests, and other sources of funding.
121	119		28 (4) Interest accrued under this section.
122	120		29 (c) The expenses of administering the fund shall be paid from
123	121		30 money in the fund.
124	122		31 (d) The treasurer of state shall invest the money in the fund not
125	123		32 currently needed to meet the obligations of the fund in the same
126	124		33 manner as other public money may be invested. Interest that
127	125		34 accrues from the investments shall be deposited in the fund.
128	126		35 (e) Money in the fund at the end of a state fiscal year does not
129	127		36 revert to the state general fund.
130	128		37 SECTION 5. [EFFECTIVE JULY 1, 2025] (a) There is
131	129		38 appropriated from the state general fund to the breast cancer
132	130		39 research fund established by IC 16-46-7.6-7, as added by this act,
133	131		40 seven million five hundred thousand dollars ($7,500,000) for the
134	132		41 purpose of awarding grants to cancer centers (as defined in
135	133		42 IC 16-46-7.6-1, as added by this act) for the state biennium

137	135		1 beginning July 1, 2025, and ending June 30, 2027.
