A BILL FOR AN ACT to amend the Indiana Code concerning
health and to make an appropriation.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 16-18-2-46.5 IS ADDED TO THE INDIANA
2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3 [EFFECTIVE JULY 1, 2025]: Sec. 46.5. "Cancer center", for
4 purposes of IC 16-46-7.6, has the meaning set forth in
5 IC 16-46-7.6-1.
6 SECTION 2. IC 16-18-2-143, AS AMENDED BY P.L.1-2010,
7 SECTION 69, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
8 JULY 1, 2025]: Sec. 143. (a) "Fund", for purposes of IC 16-26-2, has
9 the meaning set forth in IC 16-26-2-2.
10 (b) "Fund", for purposes of IC 16-31-8.5, has the meaning set forth
11 in IC 16-31-8.5-2.
12 (c) "Fund", for purposes of IC 16-41-39.4, refers to the childhood
13 lead poisoning prevention fund established by IC 16-41-39.4-3.1.
14 (d) "Fund", for purposes of IC 16-41-39.8, refers to the lead trust
15 fund established by IC 16-41-39.8-7.
16 (e) "Fund", for purposes of IC 16-46-5, has the meaning set forth in
17 IC 16-46-5-3.

1 (f) "Fund", for purposes of IC 16-46-12, has the meaning set forth
2 in IC 16-46-12-1.
3 (g) "Fund", for purposes of IC 16-41-42.2, has the meaning set forth
4 in IC 16-41-42.2-2.
5 (h) "Fund", for purposes of IC 16-35-8, has the meaning set forth in
6 IC 16-35-8-2.
7 (i) "Fund", for purposes of IC 16-46-7.6, has the meaning set
8 forth in IC 16-46-7.6-2.
9 SECTION 3. IC 16-18-2-294.5, AS AMENDED BY P.L.208-2015,
10 SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
11 JULY 1, 2025]: Sec. 294.5. (a) "Program", for purposes of IC 16-40-4,
12 has the meaning set forth in IC 16-40-4-3.
13 (b) "Program", for purposes of IC 16-41-7.5, has the meaning set
14 forth in IC 16-41-7.5-2.
15 (c) "Program", for purposes of IC 16-46-7.6, has the meaning
16 set forth in IC 16-46-7.6-3.
17 (c) (d) "Program", for purposes of IC 16-47-1, has the meaning set
18 forth in IC 16-47-1-3.
19 SECTION 4. IC 16-46-7.6 IS ADDED TO THE INDIANA CODE
20 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
21 JULY 1, 2025]:
22 Chapter 7.6. Breast Cancer Research Grant Program
23 Sec. 1. As used in this chapter, "cancer center" means one (1) of
24 the following:
25 (1) An institution that has been designated by the National
26 Cancer Institute as a:
27 (A) comprehensive cancer center;
28 (B) clinical cancer center; or
29 (C) basic laboratory cancer center.
30 (2) A cancer research facility that is formally part of an
31 approved postsecondary educational institution (as defined in
32 IC 21-7-13-6(b)).
33 Sec. 2. As used in this chapter, "fund" refers to the breast
34 cancer research fund established by section 7 of this chapter.
35 Sec. 3. As used in this chapter, "program" refers to the grant
36 program established by the state department under this chapter.
37 Sec. 4. The state department shall establish a program for the
38 purpose of providing grants to cancer centers in Indiana to
39 increase:
40 (1) breast cancer research projects; or
41 (2) breast cancer clinical trials.
42 Sec. 5. The state department shall do the following:

1 (1) Develop the application criteria and standards for
2 eligibility for cancer centers that apply for grants under the
3 program.
4 (2) Make available grants to cancer centers that meet the
5 eligibility standards developed under subdivision (1).
6 However, the state department shall prioritize grants to
7 cancer centers in the following order:
8 (A) A cancer center described in section 1(1) of this
9 chapter.
10 (B) A cancer center described in section 1(2) of this
11 chapter.
12 (3) Determine the maximum amount available for each grant.
13 (4) Determine policies for the expiration and renewal of
14 grants.
15 (5) Require that each grant be used for the purpose of breast
16 cancer research.
17 (6) Adopt rules under IC 4-22-2 necessary to implement this
18 chapter.
19 Sec. 6. The state department shall administer the program.
20 Sec. 7. (a) The breast cancer research fund is established for the
21 purpose of carrying out this chapter. The state department shall
22 administer the fund.
23 (b) The fund consists of the following:
24 (1) Appropriations from the general assembly.
25 (2) Amounts, if any, distributed to the fund from the Indiana
26 tobacco master settlement agreement fund.
27 (3) Gifts, bequests, and other sources of funding.
28 (4) Interest accrued under this section.
29 (c) The expenses of administering the fund shall be paid from
30 money in the fund.
31 (d) The treasurer of state shall invest the money in the fund not
32 currently needed to meet the obligations of the fund in the same
33 manner as other public money may be invested. Interest that
34 accrues from the investments shall be deposited in the fund.
35 (e) Money in the fund at the end of a state fiscal year does not
36 revert to the state general fund.
37 SECTION 5. [EFFECTIVE JULY 1, 2025] (a) There is
38 appropriated from the state general fund to the breast cancer
39 research fund established by IC 16-46-7.6-7, as added by this act,
40 seven million five hundred thousand dollars ($7,500,000) for the
41 purpose of awarding grants to cancer centers (as defined in
42 IC 16-46-7.6-1, as added by this act) for the state biennium

1 beginning July 1, 2025, and ending June 30, 2027.
2 (b) This SECTION expires July 1, 2027.
