1515 restrictions on a non-opioid drug prescribed for the treatment or
1616 management of pain than the coverage restrictions placed on an opioid

3333 A BILL FOR AN ACT to amend the Indiana Code concerning

3535 Be it enacted by the General Assembly of the State of Indiana:
3636 1 SECTION 1. IC 12-15-35.5-2.3 IS ADDED TO THE INDIANA
3737 2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3838 3 [EFFECTIVE JULY 1, 2025]: Sec. 2.3. As used in this chapter,
3939 4 "non-opioid drug" means a drug that:
4040 5 (1) does not act on an individual's opioid receptors; and
4141 6 (2) has been approved by the federal Food and Drug
4242 7 Administration.
4343 8 SECTION 2. IC 12-15-35.5-8.5 IS ADDED TO THE INDIANA
4444 9 CODE AS A NEW SECTION TO READ AS FOLLOWS
4545 10 [EFFECTIVE JULY 1, 2025]: Sec. 8.5. The office may not place

5454 1 Chapter 40. Coverage for Non-opioid Drugs
5555 2 Sec. 1. This chapter applies to a policy of accident and sickness
5656 3 insurance that is issued, delivered, amended, or renewed after June
5757 4 30, 2025.
5858 5 Sec. 2. As used in this chapter, "non-opioid drug" means a drug
5959 6 that:
6060 7 (1) does not act on an individual's opioid receptors; and
6161 8 (2) has been approved by the federal Food and Drug
6262 9 Administration.
6363 10 Sec. 3. As used in this chapter, "policy of accident and sickness
6464 11 insurance" has the meaning set forth in IC 27-8-5-1.
6565 12 Sec. 4. A policy of accident and sickness insurance may not place
6666 13 greater coverage restrictions on a non-opioid drug prescribed for
6767 14 the treatment or management of pain than the coverage
6868 15 restrictions placed on an opioid drug prescribed to treat or manage

7070 17 SECTION 4. IC 27-13-7-29 IS ADDED TO THE INDIANA CODE
7171 18 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
7272 19 1, 2025]: Sec. 29. (a) This section applies to an individual contract
7373 20 and a group contract that is entered into, delivered, amended, or
7474 21 renewed after June 30, 2025.
7575 22 (b) As used in this section, "non-opioid drug" means a drug
7676 23 that:
7777 24 (1) does not act on an individual's opioid receptors; and
7878 25 (2) has been approved by the federal Food and Drug
7979 26 Administration.
