8	8	the office of the secretary of family and social services may not place

10	10	treatment or management of pain than the coverage restrictions placed
11	11	on an opioid drug prescribed to treat or manage pain with respect to the
12	12	Medicaid program or the children's health insurance program. Provides
13	13	that a policy of accident and sickness insurance and a health
14	14	maintenance organization contract may not place greater coverage
15	15	restrictions on a non-opioid drug prescribed for the treatment or
16	16	management of pain than the coverage restrictions placed on an opioid
17	17	drug prescribed to treat or manage pain.

33	33	A BILL FOR AN ACT to amend the Indiana Code concerning
34	34	insurance.
35	35	Be it enacted by the General Assembly of the State of Indiana:
36	36	1 SECTION 1. IC 12-15-35.5-2.3 IS ADDED TO THE INDIANA
37	37	2 CODE AS A NEW SECTION TO READ AS FOLLOWS
38	38	3 [EFFECTIVE JULY 1, 2025]: Sec. 2.3. As used in this chapter,
39	39	4 "non-opioid drug" means a drug that:
40	40	5 (1) does not act on an individual's opioid receptors; and
41	41	6 (2) has been approved by the federal Food and Drug
42	42	7 Administration.
43	43	8 SECTION 2. IC 12-15-35.5-8.5 IS ADDED TO THE INDIANA
44	44	9 CODE AS A NEW SECTION TO READ AS FOLLOWS
45	45	10 [EFFECTIVE JULY 1, 2025]: Sec. 8.5. The office may not place
46	46	11 greater coverage restrictions on a non-opioid drug prescribed for
47	47	12 the treatment or management of pain than the coverage
48	48	13 restrictions placed on an opioid drug prescribed to treat or manage
49	49	14 pain.

54	54	1 Chapter 40. Coverage for Non-opioid Drugs
55	55	2 Sec. 1. This chapter applies to a policy of accident and sickness
56	56	3 insurance that is issued, delivered, amended, or renewed after June
57	57	4 30, 2025.
58	58	5 Sec. 2. As used in this chapter, "non-opioid drug" means a drug
59	59	6 that:
60	60	7 (1) does not act on an individual's opioid receptors; and
61	61	8 (2) has been approved by the federal Food and Drug
62	62	9 Administration.
63	63	10 Sec. 3. As used in this chapter, "policy of accident and sickness
64	64	11 insurance" has the meaning set forth in IC 27-8-5-1.
65	65	12 Sec. 4. A policy of accident and sickness insurance may not place
66	66	13 greater coverage restrictions on a non-opioid drug prescribed for
67	67	14 the treatment or management of pain than the coverage
68	68	15 restrictions placed on an opioid drug prescribed to treat or manage
69	69	16 pain.
70	70	17 SECTION 4. IC 27-13-7-29 IS ADDED TO THE INDIANA CODE
71	71	18 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
72	72	19 1, 2025]: Sec. 29. (a) This section applies to an individual contract
73	73	20 and a group contract that is entered into, delivered, amended, or
74	74	21 renewed after June 30, 2025.
75	75	22 (b) As used in this section, "non-opioid drug" means a drug
76	76	23 that:
77	77	24 (1) does not act on an individual's opioid receptors; and
78	78	25 (2) has been approved by the federal Food and Drug
79	79	26 Administration.
80	80	27 (c) An individual contract or group contract may not place
81	81	28 greater coverage restrictions on a non-opioid drug prescribed for
82	82	29 the treatment or management of pain than the coverage
83	83	30 restrictions placed on an opioid drug prescribed to treat or manage
84	84	31 pain.
