Synopsis:  Coverage of prescription pain medications. Provides that
the office of the secretary of family and social services may not place
greater coverage restrictions on a non-opioid drug prescribed for the
treatment or management of pain than the coverage restrictions placed
on an opioid drug prescribed to treat or manage pain with respect to the
Medicaid program or the children's health insurance program. Provides
that a policy of accident and sickness insurance and a health
maintenance organization contract may not place greater coverage
restrictions on a non-opioid drug prescribed for the treatment or
management of pain than the coverage restrictions placed on an opioid
drug prescribed to treat or manage pain.
Effective:  July 1, 2025.

A BILL FOR AN ACT to amend the Indiana Code concerning
insurance.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 12-15-35.5-2.3 IS ADDED TO THE INDIANA
2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3 [EFFECTIVE JULY 1, 2025]: Sec. 2.3. As used in this chapter,
4 "non-opioid drug" means a drug that:
5 (1) does not act on an individual's opioid receptors; and
6 (2) has been approved by the federal Food and Drug
7 Administration.
8 SECTION 2. IC 12-15-35.5-8.5 IS ADDED TO THE INDIANA
9 CODE AS A NEW SECTION TO READ AS FOLLOWS
10 [EFFECTIVE JULY 1, 2025]: Sec. 8.5. The office may not place
11 greater coverage restrictions on a non-opioid drug prescribed for
12 the treatment or management of pain than the coverage
13 restrictions placed on an opioid drug prescribed to treat or manage
14 pain.
15 SECTION 3. IC 27-8-40 IS ADDED TO THE INDIANA CODE AS
16 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY
17 1, 2025]:

1 Chapter 40. Coverage for Non-opioid Drugs
2 Sec. 1. This chapter applies to a policy of accident and sickness
3 insurance that is issued, delivered, amended, or renewed after June
4 30, 2025.
5 Sec. 2. As used in this chapter, "non-opioid drug" means a drug
6 that:
7 (1) does not act on an individual's opioid receptors; and
8 (2) has been approved by the federal Food and Drug
9 Administration.
10 Sec. 3. As used in this chapter, "policy of accident and sickness
11 insurance" has the meaning set forth in IC 27-8-5-1.
12 Sec. 4. A policy of accident and sickness insurance may not place
13 greater coverage restrictions on a non-opioid drug prescribed for
14 the treatment or management of pain than the coverage
15 restrictions placed on an opioid drug prescribed to treat or manage
16 pain.
17 SECTION 4. IC 27-13-7-29 IS ADDED TO THE INDIANA CODE
18 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
19 1, 2025]: Sec. 29. (a) This section applies to an individual contract
20 and a group contract that is entered into, delivered, amended, or
21 renewed after June 30, 2025.
22 (b) As used in this section, "non-opioid drug" means a drug
23 that:
24 (1) does not act on an individual's opioid receptors; and
25 (2) has been approved by the federal Food and Drug
26 Administration.
27 (c) An individual contract or group contract may not place
28 greater coverage restrictions on a non-opioid drug prescribed for
29 the treatment or management of pain than the coverage
30 restrictions placed on an opioid drug prescribed to treat or manage
31 pain.
