Citations Affected:  IC 21-49-7.
Synopsis:  STEM enrollment. Requires the board of trustees of each
state educational institution (institution) to adopt a policy that prohibits
certain foreign students from enrolling in or receiving instruction in a
qualifying STEM program offered by the institution. Requires that the
policy be established and enforced not later than August 15, 2025.
Provides that the policy must apply to certain foreign students who
enroll in an institution after August 15, 2025.
Effective:  July 1, 2025.

HOUSE BILL No. 1435
A BILL FOR AN ACT to amend the Indiana Code concerning
higher education.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 21-49-7 IS ADDED TO THE INDIANA CODE AS
2 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2025]:
4 Chapter 7. Prohibition on Participation in Qualifying STEM
5 Programs
6 Sec. 1. (a) As used in this chapter, "foreign adversary" includes
7 the following:
8 (1) A foreign country described in 15 CFR 7.4.
9 (2) A foreign country designated as a threat to critical
10 infrastructure by the governor under IC 1-1-16-8.
11 (b) The term does not include Taiwan or Taiwanese nationals.
12 Sec. 2. As used in this chapter, "foreign student" means an
13 individual who is:
14 (1) enrolled in a state educational institution;
15 (2) a citizen of a foreign adversary; and
16 (3) not a United States citizen or an alien who is admitted into
17 the United States for lawful, permanent residence.

1 Sec. 3. As used in this chapter, "qualifying STEM program"
2 refers to one (1) of the following fields of study:
3 (1) Chemical engineering.
4 (2) Electrical engineering.
5 (3) Industrial engineering.
6 (4) Mechanical engineering.
7 Sec. 4. (a) The board of trustees of each state educational
8 institution shall adopt a policy that prohibits a foreign student
9 from enrolling in or receiving instruction in a qualifying STEM
10 program offered by the state educational institution.
11 (b) The policy described in subsection (a) must:
12 (1) be established and enforced not later than August 15,
13 2025; and
14 (2) apply to any foreign student who enrolls in a state
15 educational institution after August 15, 2025.
