2828 A BILL FOR AN ACT to amend the Indiana Code concerning
2929 education and to make an appropriation.
3030 Be it enacted by the General Assembly of the State of Indiana:
3131 1 SECTION 1. IC 20-20-52 IS ADDED TO THE INDIANA CODE
3232 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
3333 3 JULY 1, 2025]:
3434 4 Chapter 52. Grants for School Counselors
3535 5 Sec. 1. This chapter does not apply to a virtual charter school
3636 6 (as defined in IC 20-24-1-10).
3737 7 Sec. 2. As used in this chapter, "fund" means the school
3838 8 counselor grant fund established by section 3 of this chapter.
3939 9 Sec. 3. (a) The school counselor grant fund is established for the
4040 10 purpose of providing school counselor grants to school
4141 11 corporations and charter schools for the employment of school
4242 12 counselors.
4343 13 (b) The fund consists of the following:
4444 14 (1) Appropriations made by the general assembly.
4545 15 (2) Gifts, grants, devises, or bequests made to the department
4646 16 to achieve the purposes of the fund.
4747 17 (c) The department shall administer the fund.

4949 1 (d) The expenses of administering the fund shall be paid from
5050 2 money in the fund.
5151 3 (e) The treasurer of state shall invest the money in the fund not
5252 4 currently needed to meet the obligations of the fund in the same
5353 5 manner as other public funds may be invested. Interest that
5454 6 accrues from these investments shall be deposited in the fund.
5555 7 (f) Money in the fund at the end of a state fiscal year does not
5656 8 revert to the state general fund but remains available to be used for
5757 9 the purposes of this chapter.
5858 10 Sec. 4. To be eligible for a school counselor grant under this
5959 11 chapter, a school corporation or charter school must submit an
6060 12 application in a manner prescribed by the department that
6161 13 includes the following information:
6262 14 (1) The current school counselor to student ratio for the
6363 15 school corporation or charter school.
6464 16 (2) A description and plan regarding how the school
6565 17 corporation or charter school intends to use a grant awarded
6666 18 under this chapter to lower the school corporation's or
6767 19 charter school's school counselor to student ratio.
6868 20 Sec. 5. The department may award school counselor grants to
6969 21 school corporations and charter schools that meet the
7070 22 requirements of this chapter.
7171 23 Sec. 6. The state board may adopt rules under IC 4-22-2 to
7272 24 implement this chapter.
7373 25 SECTION 2. [EFFECTIVE JULY 1, 2025] (a) There is
7474 26 appropriated from the state general fund to the school counselor
7575 27 grant fund established by IC 20-20-52-3, as added by this act,
7676 28 fifteen million dollars ($15,000,000) for the state biennium
7777 29 beginning July 1, 2025, and ending June 30, 2027.
7878 30 (b) This SECTION expires July 1, 2027.
