Citations Affected:  IC 3-5.
Synopsis:  Student voting. Provides, for purposes of election law, that
a document issued by a postsecondary educational institution is not
sufficient proof of identification. Modifies the residence requirements
that apply to a student attending a postsecondary educational institution
in Indiana who registers to vote.
Effective:  July 1, 2025.

HOUSE BILL No. 1644
A BILL FOR AN ACT to amend the Indiana Code concerning
elections.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 3-5-2-11.3 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2025]: Sec. 11.3. "College address", for purposes of IC 3-5-5-7,
4 means the address where a student lives when the student attends
5 the postsecondary educational institution at which the student
6 pursues the student's education.
7 SECTION 2. IC 3-5-2-35.5 IS ADDED TO THE INDIANA CODE
8 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
9 1, 2025]: Sec. 35.5. "Permanent address", for purposes of
10 IC 3-5-5-7, means the address where a student lives when the
11 student is not attending the postsecondary educational institution
12 at which the student pursues the student's education.
13 SECTION 3. IC 3-5-2-40.5, AS AMENDED BY P.L.209-2021,
14 SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
15 JULY 1, 2025]: Sec. 40.5. (a) Except as provided in subsection (b) or
16 (c), "proof of identification" refers to a document that satisfies all the
17 following:

1 (1) The document shows the name of the individual to whom the
2 document was issued, and the name conforms to the name in the
3 individual's voter registration record.
4 (2) The document shows a photograph of the individual to whom
5 the document was issued.
6 (3) The document includes an expiration date, and the document:
7 (A) is not expired; or
8 (B) expired after the date of the most recent general election.
9 (4) The document was issued by the United States or the state of
10 Indiana.
11 (b) Notwithstanding subsection (a)(3), a document issued by the
12 United States Department of Defense, the United States Department of
13 Veterans Affairs (or its predecessor, the Veterans Administration), a
14 branch of the uniformed services, the Merchant Marine, the Indiana
15 National Guard, or a Native American Indian tribe or band recognized
16 by the United States government that:
17 (1) otherwise complies with the requirements of subsection (a);
18 and
19 (2) has no expiration date or states that the document has an
20 indefinite expiration date;
21 is sufficient proof of identification for purposes of this title.
22 (c) A document issued by a postsecondary educational
23 institution is not sufficient proof of identification for purposes of
24 this title.
25 SECTION 4. IC 3-5-5-7, AS AMENDED BY P.L.169-2015,
26 SECTION 6, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
27 JULY 1, 2025]: Sec. 7. (a) Subject to section 6 of this chapter, a person
28 does not gain residency in a precinct in which the person is physically
29 present for:
30 (1) temporary employment;
31 (2) educational purposes, except as provided in subsection (b);
32 (3) preparing to purchase or occupy a residence; or
33 (4) other purposes;
34 without the intent of making a permanent home in the precinct.
35 (b) The following apply to a student attending a postsecondary
36 educational institution in Indiana:
37 (1) A student who applies to register to vote shall state the
38 student's residence address.
39 (2) A student has only one (1) residence for purposes of this title.
40 (3) A student may who meets either of the following
41 descriptions at the time the student registers to vote may state
42 the student's residence as either of the following, but not both: the

1 student's college address:
2 (A) The address where the student lives when has for at least
3 twelve (12) months resided in the precinct that includes the
4 student attends the postsecondary educational institution
5 where the student pursues the student's education. student's
6 college address.
7 (B) The address where the student lives when the student is
8 has a college address but does not attending the
9 postsecondary educational institution where the student
10 pursues the student's education. have a permanent address.
11 (4) Except as provided in subdivision (3)(A), a student who
12 has a permanent address at the time the student registers to
13 vote may not state the student's residence as the student's
14 college address.
