Summary of Legislation: Statewide Waiver Ombudsman: The bill provides that provisions of law
concerning the Statewide Waiver Ombudsman apply to an individual who has a developmental disability and
receives services administered by the Bureau of Disabilities Services. (Current law specifies that these
provisions apply to an individual who has a developmental disability and receives services under the federal
Home- and Community-Based Services program.)
The bill also specifies that these provisions do not apply to an individual served by the Long-Term Care
Ombudsman program. It changes references from "Statewide Waiver Ombudsman" to "Statewide Bureau
of Disabilities Services Ombudsman".
The bill requires the Office of the Secretary of Family and Social Services (FSSA) to prepare an annual
report on the provision of Medicaid home- and community-based waiver services, and it specifies the
information that must be included in the report.
The bill requires the FSSA to apply for an amendment to a Home- and Community-Based Services Medicaid
waiver to: (1) establish a new and proportional reimbursement level for a structured family caregiving service
arrangement; and (2) subject to specified conditions, allow a legally responsible individual to provide home-
and community-based waiver services to a Medicaid recipient.
Effective Date: July 1, 2025.
Explanation of State Expenditures: The duties of the Statewide Bureau of Disabilities Services
Ombudsman are amended to more broadly define the duties the Ombudsman, and to add the providers
delivering services for the Bureau of Disabilities Services. The number of additional cases that may result
and the complexity of those cases will determine the need for additional staff. Currently, there is one staff
position for the Ombudsman.
The report and applying to amend the Home- and Community-Based Services waiver are within the FSSA’s
routine administrative functions and should be able to be implemented with no additional appropriations,
HB 1689 1 assuming near customary agency staffing and resource levels. Additionally, some Medicaid administrative
costs are paid equally by the state and federal governments. The cost of the resulting waiver services is
indeterminate and will depend on the federal and state administrative decisions.
