32	32	A JOINT RESOLUTION proposing an amendment to Article 1 of
33	33	the Constitution of the State of Indiana concerning health.
34	34	Be it resolved by the General Assembly of the State of Indiana:
35	35	1 SECTION 1. The following amendment to the Constitution of the
36	36	2 State of Indiana is proposed and agreed to by this, the One Hundred
37	37	3 Twenty-fourth General Assembly of the State of Indiana, and is
38	38	4 referred to the next General Assembly for reconsideration and
39	39	5 agreement.
40	40	6 SECTION 2. ARTICLE 1 OF THE CONSTITUTION OF THE
41	41	7 STATE OF INDIANA IS AMENDED BY ADDING A NEW
42	42	8 SECTION TO READ AS FOLLOWS: Section 40. (a) A person has
43	43	9 the right:
44	44	10 (1) to ask pregnancy health related questions and receive the
45	45	11 answers;
46	46	12 (2) to tour a birth center;
47	47	13 (3) to choose a health care provider;

49	49	1 (4) to refuse services from a health care provider;
50	50	2 (5) to request a specific health care provider;
51	51	3 (6) to specify the gender of a health care provider;
52	52	4 (7) to refuse a health care service, procedure, or medication;
53	53	5 (8) to be accompanied by a doula;
54	54	6 (9) to submit a birth plan to a health care provider and
55	55	7 require the health care provider to follow the plan;
56	56	8 (10) to be informed of the types of delivery services offered by
57	57	9 the hospital where a baby is to be delivered;
58	58	10 (11) to be able to ask about the costs of a cesarean section at
59	59	11 a hospital and to receive the answers;
60	60	12 (12) to be able to ask about the costs of birthing and delivery
61	61	13 services and to receive the answers;
62	62	14 (13) to be able to receive alternative birthing methods;
63	63	15 (14) to be able to refuse a cervical check;
64	64	16 (15) to be able to ask about the details of medical procedures
65	65	17 and obtain answers; and
66	66	18 (16) to be able to have a medication plan and the ability to
67	67	19 change the medication plan.
68	68	20 (b) A person has the following right concerning labor:
69	69	21 (1) To be mobile.
70	70	22 (2) To stand up.
71	71	23 (3) To change positions during labor.
72	72	24 (4) To have whom the patient wants in the labor room.
73	73	25 (5) To be informed of and be able to refuse an episiotomy.
74	74	26 (6) To delay umbilical cord cutting.
75	75	27 (7) To keep a placenta.
76	76	28 (8) To refuse third stage labor management.
77	77	29 (9) To refuse labor inducing medication.
78	78	30 (10) To refuse a cervical check.
