3232 A JOINT RESOLUTION proposing an amendment to Article 1 of
3333 the Constitution of the State of Indiana concerning health.
3434 Be it resolved by the General Assembly of the State of Indiana:
3535 1 SECTION 1. The following amendment to the Constitution of the
3636 2 State of Indiana is proposed and agreed to by this, the One Hundred
3737 3 Twenty-fourth General Assembly of the State of Indiana, and is
3838 4 referred to the next General Assembly for reconsideration and
3939 5 agreement.
4040 6 SECTION 2. ARTICLE 1 OF THE CONSTITUTION OF THE
4141 7 STATE OF INDIANA IS AMENDED BY ADDING A NEW
4242 8 SECTION TO READ AS FOLLOWS: Section 40. (a) A person has
4343 9 the right:
4444 10 (1) to ask pregnancy health related questions and receive the
4545 11 answers;
4646 12 (2) to tour a birth center;
4747 13 (3) to choose a health care provider;

4949 1 (4) to refuse services from a health care provider;
5050 2 (5) to request a specific health care provider;
5151 3 (6) to specify the gender of a health care provider;
5252 4 (7) to refuse a health care service, procedure, or medication;
5353 5 (8) to be accompanied by a doula;
5454 6 (9) to submit a birth plan to a health care provider and
5555 7 require the health care provider to follow the plan;
5656 8 (10) to be informed of the types of delivery services offered by
5757 9 the hospital where a baby is to be delivered;
5858 10 (11) to be able to ask about the costs of a cesarean section at
5959 11 a hospital and to receive the answers;
6060 12 (12) to be able to ask about the costs of birthing and delivery
6161 13 services and to receive the answers;
6262 14 (13) to be able to receive alternative birthing methods;
6363 15 (14) to be able to refuse a cervical check;
6464 16 (15) to be able to ask about the details of medical procedures
6565 17 and obtain answers; and
6666 18 (16) to be able to have a medication plan and the ability to
6767 19 change the medication plan.
6868 20 (b) A person has the following right concerning labor:
6969 21 (1) To be mobile.

7171 23 (3) To change positions during labor.
7272 24 (4) To have whom the patient wants in the labor room.
7373 25 (5) To be informed of and be able to refuse an episiotomy.
7474 26 (6) To delay umbilical cord cutting.

7676 28 (8) To refuse third stage labor management.
