HOUSE JOINT RESOLUTION A JOINT RESOLUTION proposing an amendment to Article 1 of the Constitution of the State of Indiana concerning health. Be it resolved by the General Assembly of the State of Indiana: 1 SECTION 1. The following amendment to the Constitution of the 2 State of Indiana is proposed and agreed to by this, the One Hundred 3 Twenty-fourth General Assembly of the State of Indiana, and is 4 referred to the next General Assembly for reconsideration and 5 agreement. 6 SECTION 2. ARTICLE 1 OF THE CONSTITUTION OF THE 7 STATE OF INDIANA IS AMENDED BY ADDING A NEW 8 SECTION TO READ AS FOLLOWS: Section 40. (a) A person has 9 the right: 10 (1) to ask pregnancy health related questions and receive the 11 answers; 12 (2) to tour a birth center; 13 (3) to choose a health care provider; 2025 HJ 9207/DI 107 2 1 (4) to refuse services from a health care provider; 2 (5) to request a specific health care provider; 3 (6) to specify the gender of a health care provider; 4 (7) to refuse a health care service, procedure, or medication; 5 (8) to be accompanied by a doula; 6 (9) to submit a birth plan to a health care provider and 7 require the health care provider to follow the plan; 8 (10) to be informed of the types of delivery services offered by 9 the hospital where a baby is to be delivered; 10 (11) to be able to ask about the costs of a cesarean section at 11 a hospital and to receive the answers; 12 (12) to be able to ask about the costs of birthing and delivery 13 services and to receive the answers; 14 (13) to be able to receive alternative birthing methods; 15 (14) to be able to refuse a cervical check; 16 (15) to be able to ask about the details of medical procedures 17 and obtain answers; and 18 (16) to be able to have a medication plan and the ability to 19 change the medication plan. 20 (b) A person has the following right concerning labor: 21 (1) To be mobile. 22 (2) To stand up. 23 (3) To change positions during labor. 24 (4) To have whom the patient wants in the labor room. 25 (5) To be informed of and be able to refuse an episiotomy. 26 (6) To delay umbilical cord cutting. 27 (7) To keep a placenta. 28 (8) To refuse third stage labor management. 29 (9) To refuse labor inducing medication. 30 (10) To refuse a cervical check. 31 (11) To keep the baby in the room. 32 (12) To have the baby skin to skin. 33 (13) To refuse circumcision. 34 (14) To refuse drugs. 35 (15) To keep medical information private. 2025 HJ 9207/DI 107
