88 Requires the driver education advisory board to consult with the

1212 motor vehicles (bureau) regarding driver education in: (1) the
1313 procedures of a law enforcement officer during a traffic stop; and (2)
1414 the actions a person should take during a traffic stop, including
1515 appropriate interaction with a law enforcement officer. Requires the
1616 bureau to include in any driver education manual published by the
1717 bureau the following: (1) A description of the procedures of a law
1818 enforcement officer during a traffic stop. (2) An explanation of the
1919 actions a person should take during a traffic stop, including appropriate
2020 interaction with a law enforcement officer. Provides that driver
2121 education curriculum must include instruction about actions to take
2222 during a traffic stop and the appropriate interaction with a law
2323 enforcement officer during a traffic stop.

4141 A BILL FOR AN ACT to amend the Indiana Code concerning
4242 motor vehicles.
4343 Be it enacted by the General Assembly of the State of Indiana:
4444 1 SECTION 1. IC 9-27-6-5, AS AMENDED BY P.L.85-2013,
4545 2 SECTION 71, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
4646 3 JULY 1, 2025]: Sec. 5. (a) As used in this section, "advisory board"
4747 4 refers to the driver education advisory board established by subsection
4848 5 (b).
4949 6 (b) The driver education advisory board is established to advise the
5050 7 commissioner in the administration of the policies of the commission
5151 8 and the bureau regarding driver education.
5252 9 (c) The advisory board is composed of seven (7) individuals
5353 10 appointed by the commissioner as follows:
5454 11 (1) Three (3) members must be driver education professionals
5555 12 endorsed by the bureau under section 8 of this chapter. In the
5656 13 selection of individuals for membership under this subdivision,
5757 14 consideration must be given to driver education instruction
5858 15 performed in urban and rural areas.
5959 16 (2) One (1) member must be a traffic safety advocate.
6060 17 (3) One (1) member must be a representative of the bureau.

6262 1 (4) One (1) member must be a representative of higher education.
6363 2 (5) One (1) member must be a representative of the insurance
6464 3 industry.
6565 4 (d) A member of the advisory board serves a two (2) year term. A
6666 5 member may not be appointed to more than two (2) consecutive full
6767 6 terms. Each member serves until the member's successor is appointed
6868 7 and qualified.
6969 8 (e) A member of the advisory board may be removed for good
7070 9 cause.
7171 10 (f) A vacancy on the advisory board shall be filled by the
7272 11 appointment by the commissioner of an individual to fill the position
7373 12 to which the vacating member was appointed under subsection (c) for
7474 13 the vacating member's unexpired term.
7575 14 (g) The advisory board shall:
7676 15 (1) consult with and advise the commissioner in the
7777 16 administration of the policies of the commission and the bureau
7878 17 regarding driver education; and
7979 18 (2) suggest rules regarding the education and training of persons
8080 19 to operate or drive motor vehicles or to prepare a person for an
8181 20 examination or validation for a driver's license; and
8282 21 (3) consult with the commissioner and the state police
8383 22 department, and advise the commissioner in the
8484 23 administration of the policies of the commission and the
8585 24 bureau regarding driver education in:
8686 25 (A) the procedures of a law enforcement officer during a
8787 26 traffic stop; and
8888 27 (B) the actions a person should take during a traffic stop,
8989 28 including appropriate interaction with a law enforcement
9090 29 officer.
9191 30 (h) A member of the advisory board is not subject to liability in a
9292 31 civil action for bodily injury or property damage arising from or
9393 32 thought to have arisen from an action taken in good faith as a member
9494 33 of the advisory board.
9595 34 SECTION 2. IC 9-27-6-10.5 IS ADDED TO THE INDIANA CODE
9696 35 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
9797 36 1, 2025]: Sec. 10.5. The bureau shall include in any driver
9898 37 education manual published by the bureau the following:
9999 38 (1) A description of the procedures of a law enforcement
100100 39 officer during a traffic stop.
101101 40 (2) An explanation of the actions a person should take during
102102 41 a traffic stop, including appropriate interaction with a law
103103 42 enforcement officer.

105105 1 SECTION 3. IC 9-27-6-11, AS AMENDED BY P.L.150-2015,
106106 2 SECTION 6, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
107107 3 JULY 1, 2025]: Sec. 11. In addition to adopting rules under sections
108108 4 6(b), 8(b), and 9(b) of this chapter, the bureau shall adopt rules under
109109 5 IC 4-22-2 concerning the following:
110110 6 (1) Methods and procedures for the investigation and evaluation
111111 7 of the qualifications of individuals applying for licenses under
112112 8 sections 6 and 8 of this chapter.
113113 9 (2) The criteria upon which to issue, deny, suspend, renew, and
114114 10 revoke licenses under section 10 of this chapter, including
115115 11 requirements for continuing education for instructors.
116116 12 (3) Procedures for:
117117 13 (A) the investigation into potential grounds for; and
118118 14 (B) conduct of hearings on;
119119 15 the issuance, renewal, cancellation, suspension, or revocation of
120120 16 a license.
121121 17 (4) Standards for classroom and in-car driver education
122122 18 curriculum (including classroom instruction, Internet instruction,
123123 19 and practice driving) and equipment. Classroom instruction
124124 20 standards established under this subdivision must provide for
125125 21 instruction about:
126126 22 (A) railroad-highway grade crossing safety; and
127127 23 (B) the procedure for participation in the human organ donor
128128 24 program;
129129 25 (C) actions to take during a traffic stop; and
130130 26 (D) appropriate interaction with a law enforcement officer
131131 27 during a traffic stop;
132132 28 and must limit classroom instruction to students at least fifteen
133133 29 (15) years of age.
134134 30 (5) Limitations on the number of:
135135 31 (A) hours an instructor may teach in a day; and
136136 32 (B) classroom and driving hours in which a driver education
137137 33 student may participate during a day.
138138 34 (6) Programs to improve parental involvement in driver
139139 35 education.
140140 36 (7) Establishment and maintenance of standards for instructors of
141141 37 driver education, including:
142142 38 (A) secondary school driver education instructors;
143143 39 (B) driver training school instructors; and
144144 40 (C) higher education driver education instructors.
145145 41 (8) Minimum hours of instruction for an approved driver
146146 42 education course that include:

148148 1 (A) thirty (30) hours of classroom or online training; and
149149 2 (B) six (6) hours of behind-the-wheel training.
