31	30		SENATE BILL No. 40
32	31		A BILL FOR AN ACT to amend the Indiana Code concerning
33	32		natural and cultural resources.
34	33		Be it enacted by the General Assembly of the State of Indiana:
35	34		1 SECTION 1. IC 14-13-2-19 IS AMENDED TO READ AS
36	35		2 FOLLOWS [EFFECTIVE JULY 1, 2025]: Sec. 19. (a) The Little
37	36		3 Calumet River project development fund is created. The commission
38	37		4 shall make expenditures from the fund only to accomplish the purposes
39	38		5 of this chapter and in accordance with section 33 of this chapter.
40	39		6 (b) The commission shall do the following:
41	40		7 (1) Hold the fund in the name of the commission.
42	41		8 (2) Administer the fund.
43	42		9 (3) Make all expenditures from the fund.
44	43		10 (c) The money in the fund at the end of a fiscal year remains in the
45	44		11 fund and does not revert to any other fund.
46	45		12 SECTION 2. IC 14-13-2-31, AS AMENDED BY P.L.106-2012,
47	46		13 SECTION 18, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
48	47		14 JULY 1, 2025]: Sec. 31. (a) Subject to subsection (c), before November
49	48		15 1 of each year, the commission shall make a report of the commission's
50	49		16 activities to the following:
51	50		17 (1) The governor.

53	52		1 (2) The legislative council.
54	53		2 (3) The board of county commissioners of Lake County.
55	54		3 (b) A report made to the legislative council under this section must
56	55		4 be in an electronic format under IC 5-14-6.
57	56		5 (c) The governor may require the commission to issue reports more
58	57		6 frequently than would otherwise be required under subsection (a).
59	58		7 (d) Before November 1 of each year, the commission shall make
60	59		8 a report of the commission's expenditures and activities to the
61	60		9 county council of Lake County.
62	61		10 SECTION 3. IC 14-13-2-33 IS ADDED TO THE INDIANA CODE
63	62		11 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
64	63		12 1, 2025]: Sec. 33. Before September 1 of each year, the commission
65	64		13 shall submit a budget to the county council of Lake County for
66	65		14 nonbinding review.

70	69		which was referred Senate Bill No. 40, has had the same under
71	70		consideration and begs leave to report the same back to the Senate with
72	71		the recommendation that said bill be AMENDED as follows:

74	73		Page 2, line 14, delete "approval." and insert "nonbinding review.".

76	75		and when so amended that said bill do pass and be reassigned to the
77	76		Senate Committee on Tax and Fiscal Policy.
