2828 A BILL FOR AN ACT to amend the Indiana Code concerning
2929 natural and cultural resources.
3030 Be it enacted by the General Assembly of the State of Indiana:
3131 1 SECTION 1. IC 14-34-12-4 IS ADDED TO THE INDIANA CODE
3232 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3333 3 1, 2025]: Sec. 4. (a) The legislative body of a consolidated city may
3434 4 adopt an ordinance to regulate blasting operations to mitigate the
3535 5 impact on the health and safety of residential neighborhoods within
3636 6 a one (1) mile radius of blasting operations in the consolidated city,
3737 7 including the following:
3838 8 (1) The type of chemicals used in explosives.
3939 9 (2) The air pollutants released.
4040 10 (3) The noise and vibration disturbance.
4141 11 (4) The distance and power of blasts to protect nearby
4242 12 residences from chemical or structural damage.
4343 13 (b) Notwithstanding IC 22-13-2-3, an ordinance adopted under
4444 14 subsection (a) may provide more stringent requirements than the
4545 15 following:
4646 16 (1) Rules adopted by the commission under this chapter.
