88 Synopsis: Abortion inducing drugs. Provides that a person who
99 knowingly or intentionally engages in the use of an abortion inducing
1010 drug, including Mifepristone or Misoprostol, on a pregnant woman
1111 without the knowledge or consent of the pregnant woman, commits a
1212 Level 5 felony. Prohibits a person from knowingly or intentionally
1313 sending Mifepristone or Misoprostol to another person located in
1414 Indiana, if the other person located in Indiana possesses the
1515 Mifepristone or Misoprostol. Provides that each offense is a Class A
1616 misdemeanor with a Level 6 felony for subsequent offenses. Adds
1717 Mifepristone and Misoprostol to the list of Schedule IV drugs.

3434 A BILL FOR AN ACT to amend the Indiana Code concerning
3535 health.
3636 Be it enacted by the General Assembly of the State of Indiana:
3737 1 SECTION 1. IC 16-34-6-5, AS ADDED BY P.L.93-2022,
3838 2 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3939 3 JULY 1, 2025]: Sec. 5. (a) A person who knowingly or intentionally
4040 4 coerces a pregnant woman to have an abortion commits a Level 6
4141 5 felony.
4242 6 (b) A person who knowingly or intentionally engages in the use
4343 7 of an abortion inducing drug, including Mifepristone and
4444 8 Misoprostol, on a pregnant woman without the knowledge or
4545 9 consent of the pregnant woman, commits a Level 5 felony.
4646 10 (c) An offense described in subsection (b) is a Level 4 felony if
4747 11 the unborn child is more than three (3) months of gestational age.
4848 12 SECTION 2. IC 16-42-22.5 IS ADDED TO THE INDIANA CODE

5151 15 Chapter 22.5. Drugs: Mifepristone and Misoprostol Restrictions
5252 16 Sec. 1. This chapter does not apply to:
5353 17 (1) the transport of Mifepristone or Misoprostol from a

5555 1 person in another state in continuous transit through Indiana
5656 2 to a person in another state; or
5757 3 (2) the shipping of Mifepristone or Misoprostol to a hospital
5858 4 or pharmacy.
5959 5 Sec. 2. A person commits unlawful sending of Mifepristone or
6060 6 Misoprostol, a Class A misdemeanor, if:
6161 7 (1) the person knowingly or intentionally sends Mifepristone
6262 8 or Misoprostol to another person located in Indiana; and
6363 9 (2) the other person located in Indiana possesses the
6464 10 Mifepristone or Misoprostol.
6565 11 However, the offense is a Level 6 felony if the person has a prior
6666 12 unrelated conviction for a violation of this section.
6767 13 SECTION 3. IC 35-48-2-10, AS AMENDED BY P.L.84-2024,
6868 14 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
6969 15 JULY 1, 2025]: Sec. 10. (a) The controlled substances listed in this
7070 16 section are included in schedule IV.
7171 17 (b) Narcotic drugs. Unless specifically excepted in a rule adopted
7272 18 by the board or unless listed in another schedule, any material,
7373 19 compound, mixture, or preparation containing any of the following
7474 20 narcotic drugs, or their salts calculated as the free anhydrous base or
7575 21 alkaloid, in the following limited quantities:
7676 22 (1) Not more than 1 milligram of difenoxin (9618) and not less
7777 23 than 25 micrograms of atropine sulfate per dosage unit.
7878 24 (2) Dextropropoxyphene (alpha- (+)-4-dimethylamino-1,2-
7979 25 diphenyl-3-methyl-2-propionoxybutane (9278).
8080 26 (c) Depressants. Unless specifically excepted in a rule adopted by
8181 27 the board or unless listed in another schedule, any material, compound,
8282 28 mixture, or preparation which contains any quantity of the following
8383 29 substances, including its salts, isomers, and salts of isomers whenever
8484 30 the existence of such salts, isomers, and salts of isomers is possible
8585 31 within the specific chemical designation:

185185 2 compound, mixture, or preparation contains one (1) or more active
186186 3 medicinal ingredients not having a depressant effect on the central
187187 4 nervous system, and if the admixtures are included therein in
188188 5 combinations, quantity, proportion, or concentration that vitiate the
189189 6 potential for abuse of the substances which have a depressant effect on
190190 7 the central nervous system.
191191 8 SECTION 4. IC 35-52-16-23.5, AS ADDED BY P.L.93-2022,
192192 9 SECTION 6, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
193193 10 JULY 1, 2025]: Sec. 23.5. IC 16-34-6-5 defines a crime crimes
194194 11 concerning coerced abortion and the use of abortion inducing drugs
