DIGEST OF INTRODUCED BILL

Synopsis:  Abortion inducing drugs. Provides that a person who
knowingly or intentionally engages in the use of an abortion inducing
drug, including Mifepristone or Misoprostol, on a pregnant woman
without the knowledge or consent of the pregnant woman, commits a
Level 5 felony. Prohibits a person from knowingly or intentionally
sending Mifepristone or Misoprostol to another person located in
Indiana, if the other person located in Indiana possesses the
Mifepristone or Misoprostol. Provides that each offense is a Class A
misdemeanor with a Level 6 felony for subsequent offenses. Adds
Mifepristone and Misoprostol to the list of Schedule IV drugs.

SENATE BILL No. 245
A BILL FOR AN ACT to amend the Indiana Code concerning
health.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 16-34-6-5, AS ADDED BY P.L.93-2022,
2 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2025]: Sec. 5. (a) A person who knowingly or intentionally
4 coerces a pregnant woman to have an abortion commits a Level 6
5 felony.
6 (b) A person who knowingly or intentionally engages in the use
7 of an abortion inducing drug, including Mifepristone and
8 Misoprostol, on a pregnant woman without the knowledge or
9 consent of the pregnant woman, commits a Level 5 felony.
10 (c) An offense described in subsection (b) is a Level 4 felony if
11 the unborn child is more than three (3) months of gestational age.
12 SECTION 2. IC 16-42-22.5 IS ADDED TO THE INDIANA CODE
13 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
14 JULY 1, 2025]:
15 Chapter 22.5. Drugs: Mifepristone and Misoprostol Restrictions
16 Sec. 1. This chapter does not apply to:
17 (1) the transport of Mifepristone or Misoprostol from a

1 person in another state in continuous transit through Indiana
2 to a person in another state; or
3 (2) the shipping of Mifepristone or Misoprostol to a hospital
4 or pharmacy.
5 Sec. 2. A person commits unlawful sending of Mifepristone or
6 Misoprostol, a Class A misdemeanor, if:
7 (1) the person knowingly or intentionally sends Mifepristone
8 or Misoprostol to another person located in Indiana; and
9 (2) the other person located in Indiana possesses the
10 Mifepristone or Misoprostol.
11 However, the offense is a Level 6 felony if the person has a prior
12 unrelated conviction for a violation of this section.
13 SECTION 3. IC 35-48-2-10, AS AMENDED BY P.L.84-2024,
14 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
15 JULY 1, 2025]: Sec. 10. (a) The controlled substances listed in this
16 section are included in schedule IV.
17 (b) Narcotic drugs. Unless specifically excepted in a rule adopted
18 by the board or unless listed in another schedule, any material,
19 compound, mixture, or preparation containing any of the following
20 narcotic drugs, or their salts calculated as the free anhydrous base or
21 alkaloid, in the following limited quantities:
22 (1) Not more than 1 milligram of difenoxin (9618) and not less
23 than 25 micrograms of atropine sulfate per dosage unit.
24 (2) Dextropropoxyphene (alpha- (+)-4-dimethylamino-1,2-
25 diphenyl-3-methyl-2-propionoxybutane (9278).
26 (c) Depressants. Unless specifically excepted in a rule adopted by
27 the board or unless listed in another schedule, any material, compound,
28 mixture, or preparation which contains any quantity of the following
29 substances, including its salts, isomers, and salts of isomers whenever
30 the existence of such salts, isomers, and salts of isomers is possible
31 within the specific chemical designation:

35 Brexanolone (2400).
36 Bromazepam (2748).

38 Carisoprodol.

8 (d) Stimulants. Unless specifically excepted in a rule adopted by the

11 substances having a stimulant effect on the central nervous system,
12 including its salts, isomers (whether optical, position, or geometric),
13 and salts of such isomers whenever the existence of such salts, isomers,
14 and salts of isomers is possible within the specific chemical
15 designation:
16 Cathine ((+)-norpseudoephedrine) (1230).
17 Diethylpropion (1610).
18 Fencamfamin (1760).
19 Fenproporex (1575).
20 Mazindol (1605).
21 Mefenorex (1580).
22 Modafinil (1680).
23 Pemoline (including organometallic complexes and chelates
24 thereof) (1530).

29 Solriamfetol (2-amino-3-phenylpropyl carbamate;

32 (e) Other substances. Unless specifically excepted or unless listed
33 in another schedule, any material, compound, mixture, or preparation
34 which contains any quantity of the following substances including its
35 salts:
36 Butorphanol (including its optical isomers) (9720).
37 Pentazocine (9709).
38 (f) Tramadol (Ultram).
39 (g) Mifepristone.
40 (h) Misoprostol.
41 (g) (i) The board may except by rule any compound, mixture, or
42 preparation containing any depressant substance listed in subsection

1 (b), (c), (d), or (e), from the application of any part of this article if the
2 compound, mixture, or preparation contains one (1) or more active
3 medicinal ingredients not having a depressant effect on the central
4 nervous system, and if the admixtures are included therein in
5 combinations, quantity, proportion, or concentration that vitiate the
6 potential for abuse of the substances which have a depressant effect on
7 the central nervous system.
8 SECTION 4. IC 35-52-16-23.5, AS ADDED BY P.L.93-2022,
9 SECTION 6, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
10 JULY 1, 2025]: Sec. 23.5. IC 16-34-6-5 defines a crime crimes
11 concerning coerced abortion and the use of abortion inducing drugs
12 without the knowledge or consent of the pregnant woman.
13 SECTION 5. IC 35-52-16-90.1 IS ADDED TO THE INDIANA
14 CODE AS A NEW SECTION TO READ AS FOLLOWS
15 [EFFECTIVE JULY 1, 2025]: Sec. 90.1. IC 16-42-22.5-2 defines a
16 crime concerning abortion inducing drugs.
