Synopsis:  Water safety curricula and drowning reporting. Requires the
Indiana department of health to collect and publish certain information
concerning drowning deaths in Indiana. Requires the department of
education to develop curricula regarding water safety. Requires a
school corporation to provide instruction on water safety as a part of
the health education curriculum for students enrolled in kindergarten
through grade 12. 
Effective:  July 1, 2025.

SENATE BILL No. 329
A BILL FOR AN ACT to amend the Indiana Code concerning
education.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 16-19-3-19.5 IS ADDED TO THE INDIANA
2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3 [EFFECTIVE JULY 1, 2025]: Sec. 19.5. (a) The state department
4 shall collect the following information concerning drowning deaths
5 in Indiana:
6 (1) The location of the drowning.
7 (2) The age of the individual at the time of the drowning.
8 (b) Beginning July 1, 2026, and each July 1 thereafter, the state
9 department shall publish the information collected under
10 subsection (a) on the state department's website.
11 SECTION 2. IC 20-30-5-9.5 IS ADDED TO THE INDIANA CODE
12 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
13 1, 2025]: Sec. 9.5. (a) The governing body of each school
14 corporation shall provide instruction regarding water safety as a
15 part of the health education curriculum for students enrolled in
16 kindergarten through grade 12.
17 (b) The department shall develop curricula for use by school

1 corporations under subsection (a).
2 (c) Curricula developed under subsection (b) must include age
3 appropriate instruction on the following topics:
4 (1) The proper use of flotation devices.
5 (2) Awareness of water conditions.
6 (3) The proper supervision of swim areas.
7 (4) Safe behaviors in and around the water.
8 (5) The importance of:
9 (A) pool barriers and fencing;
10 (B) formal swim lessons;
11 (C) avoiding alcohol and substance use with water
12 recreation; and
13 (D) cardiopulmonary resuscitation for drowning victims
14 and the importance of administering cardiopulmonary
15 resuscitation.
