44 | 44 | | Be it enacted by the General Assembly of the State of Indiana: |

47 | 47 | | 3 [EFFECTIVE JULY 1, 2025]: Sec. 4.2. (a) A child care center must |
---|
48 | 48 | | 4 be equipped with closed circuit video cameras in sufficient number |
---|
49 | 49 | | 5 and location to allow visual monitoring of every space inside the |
---|
50 | 50 | | 6 child care center, with the exception of adult bathrooms, that can |
---|
51 | 51 | | 7 reasonably be expected to be occupied by children. |
---|
52 | 52 | | 8 (b) A child care center shall provide notice to parents of |
---|
53 | 53 | | 9 children for whom the child care center provides care that children |
---|
54 | 54 | | 10 are subject to video monitoring inside the child care center. |
---|
55 | 55 | | 11 (c) A child care center shall: |
---|
56 | 56 | | 12 (1) record the footage captured by each camera described in |
---|
57 | 57 | | 13 subsection (a); and |
---|
58 | 58 | | 14 (2) except as provided under subsection (d), retain footage |
---|
59 | 59 | | 15 recorded under subdivision (1) for ninety (90) days after the |
---|
60 | 60 | | 16 date on which the footage is recorded. |

---|

---|
70 | 70 | | 8 footage recorded by the child care center's cameras under |
---|
71 | 71 | | 9 subsection (c) until the parent has been given an opportunity to |
---|
72 | 72 | | 10 view the footage under subsection (f). |
---|
73 | 73 | | 11 (e) A parent who has reason to believe that a crime was |
---|
74 | 74 | | 12 committed against the parent's child while the child was at a child |
---|
75 | 75 | | 13 care center may view the footage recorded by the child care center |
---|
76 | 76 | | 14 under subsection (c). |
---|
77 | 77 | | 15 (f) Upon receiving a request to view footage from a parent |
---|
78 | 78 | | 16 under subsection (e), a child care center shall: |
---|
79 | 79 | | 17 (1) respond to the request not later than five (5) days after |
---|
80 | 80 | | 18 receiving the request; and |
---|
81 | 81 | | 19 (2) allow the parent to view the footage during the child care |
---|
82 | 82 | | 20 center's business hours. |
---|
83 | 83 | | 21 (g) An individual who, based on footage captured on cameras |
---|
84 | 84 | | 22 described in subsection (a) and viewed by the individual, has |
---|
85 | 85 | | 23 reason to believe that a child is a victim of child abuse or neglect |
---|
86 | 86 | | 24 shall make a report of the suspected abuse or neglect as required |
---|
87 | 87 | | 25 under IC 31-33. |
