77 Synopsis: Security cameras at child care centers. Requires a child care
88 center to: (1) be equipped with cameras in sufficient number and
99 location to allow visual monitoring of every space inside the child care
1010 center, with the exception of adult bathrooms, that can reasonably be
1111 expected to be occupied by children; and (2) provide notice to parents
1212 that children are subject to video monitoring inside the child care
1313 center. Requires a child care center to record footage captured by the
1414 child care center's cameras and retain the footage for 90 days, unless:
1515 (1) the child care center receives notice of a suspected crime
1616 committed against a child at the child care center, in which case the
1717 child care center must retain all footage until the investigation of the
1818 suspected crime is complete; or (2) the child care center receives a
1919 request from a parent to view the footage, in which case the child care
2020 center must retain all footage until the parent has had an opportunity to
2121 view the footage. Allows a parent of a child who has reason to believe
2222 that a crime was committed against the parent's child at a child care
2323 center to view the footage recorded by the child care center. Requires
2424 an individual to report suspected child abuse and neglect witnessed by
2525 the individual on a child care center's camera footage.

4242 A BILL FOR AN ACT to amend the Indiana Code concerning
4343 human services.
4444 Be it enacted by the General Assembly of the State of Indiana:
4545 1 SECTION 1. IC 12-17.2-4-4.2 IS ADDED TO THE INDIANA
4646 2 CODE AS A NEW SECTION TO READ AS FOLLOWS
4747 3 [EFFECTIVE JULY 1, 2025]: Sec. 4.2. (a) A child care center must
4848 4 be equipped with closed circuit video cameras in sufficient number
4949 5 and location to allow visual monitoring of every space inside the
5050 6 child care center, with the exception of adult bathrooms, that can
5151 7 reasonably be expected to be occupied by children.
5252 8 (b) A child care center shall provide notice to parents of
5353 9 children for whom the child care center provides care that children
5454 10 are subject to video monitoring inside the child care center.
5555 11 (c) A child care center shall:
5656 12 (1) record the footage captured by each camera described in
5757 13 subsection (a); and
5858 14 (2) except as provided under subsection (d), retain footage
5959 15 recorded under subdivision (1) for ninety (90) days after the
6060 16 date on which the footage is recorded.
6161 17 (d) A child care center that receives notice from a law

6363 1 enforcement official of a suspected crime committed against a child
6464 2 at the child care center may not delete or dispose of any footage
6565 3 recorded by the child care center's cameras under subsection (c)
6666 4 until the law enforcement investigation of the suspected crime is
6767 5 complete. A child care center that receives notice of a suspected
6868 6 crime committed against a child at the child care center from a
6969 7 parent under subsection (e) may not delete or dispose of any
7070 8 footage recorded by the child care center's cameras under
7171 9 subsection (c) until the parent has been given an opportunity to
7272 10 view the footage under subsection (f).
7373 11 (e) A parent who has reason to believe that a crime was
7474 12 committed against the parent's child while the child was at a child
7575 13 care center may view the footage recorded by the child care center
7676 14 under subsection (c).
7777 15 (f) Upon receiving a request to view footage from a parent
7878 16 under subsection (e), a child care center shall:
7979 17 (1) respond to the request not later than five (5) days after
8080 18 receiving the request; and
8181 19 (2) allow the parent to view the footage during the child care
8282 20 center's business hours.
8383 21 (g) An individual who, based on footage captured on cameras
8484 22 described in subsection (a) and viewed by the individual, has
8585 23 reason to believe that a child is a victim of child abuse or neglect
8686 24 shall make a report of the suspected abuse or neglect as required
8787 25 under IC 31-33.
