Requires a child care center to: (1) be equipped with cameras in sufficient number and location to allow visual monitoring of every space inside the child care center, with the exception of adult bathrooms, that can reasonably be expected to be occupied by children; and (2) provide notice to parents that children are subject to video monitoring inside the child care center. Requires a child care center to record footage captured by the child care center's cameras and retain the footage for 90 days, unless: (1) the child care center receives notice of a suspected crime committed against a child at the child care center, in which case the child care center must retain all footage until the investigation of the suspected crime is complete; or (2) the child care center receives a request from a parent to view the footage, in which case the child care center must retain all footage until the parent has had an opportunity to view the footage. Allows a parent of a child who has reason to believe that a crime was committed against the parent's child at a child care center to view the footage recorded by the child care center. Requires an individual to report suspected child abuse and neglect witnessed by the individual on a child care center's camera footage. Effective: July 1, 2025. SENATE BILL No. 369 A BILL FOR AN ACT to amend the Indiana Code concerning human services. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 12-17.2-4-4.2 IS ADDED TO THE INDIANA 2 CODE AS A NEW SECTION TO READ AS FOLLOWS 3 [EFFECTIVE JULY 1, 2025]: Sec. 4.2. (a) A child care center must 4 be equipped with closed circuit video cameras in sufficient number 5 and location to allow visual monitoring of every space inside the 6 child care center, with the exception of adult bathrooms, that can 7 reasonably be expected to be occupied by children. 8 (b) A child care center shall provide notice to parents of 9 children for whom the child care center provides care that children 10 are subject to video monitoring inside the child care center. 11 (c) A child care center shall: 12 (1) record the footage captured by each camera described in 13 subsection (a); and 14 (2) except as provided under subsection (d), retain footage 15 recorded under subdivision (1) for ninety (90) days after the 16 date on which the footage is recorded. 17 (d) A child care center that receives notice from a law 2025 IN 369—LS 7225/DI 119 2 1 enforcement official of a suspected crime committed against a child 2 at the child care center may not delete or dispose of any footage 3 recorded by the child care center's cameras under subsection (c) 4 until the law enforcement investigation of the suspected crime is 5 complete. A child care center that receives notice of a suspected 6 crime committed against a child at the child care center from a 7 parent under subsection (e) may not delete or dispose of any 8 footage recorded by the child care center's cameras under 9 subsection (c) until the parent has been given an opportunity to 10 view the footage under subsection (f). 11 (e) A parent who has reason to believe that a crime was 12 committed against the parent's child while the child was at a child 13 care center may view the footage recorded by the child care center 14 under subsection (c). 15 (f) Upon receiving a request to view footage from a parent 16 under subsection (e), a child care center shall: 17 (1) respond to the request not later than five (5) days after 18 receiving the request; and 19 (2) allow the parent to view the footage during the child care 20 center's business hours. 21 (g) An individual who, based on footage captured on cameras 22 described in subsection (a) and viewed by the individual, has 23 reason to believe that a child is a victim of child abuse or neglect 24 shall make a report of the suspected abuse or neglect as required 25 under IC 31-33. 2025 IN 369—LS 7225/DI 119
