77 Synopsis: Regulation of homeschooling. Requires a parent who
88 withdraws the parent's chronically absent child from a public school in
99 order to homeschool the child to: (1) present to the school from which
1010 the child is withdrawing a plan regarding the curriculum and courses
1111 the child will complete while homeschooled; (2) meet with the
1212 superintendent of the school from which the child is withdrawing not
1313 less than two times each semester for the first full school year in which
1414 the student is homeschooled to provide a progress report; and (3) meet
1515 with the superintendent not less than two times annually for each
1616 subsequent school year. Requires a superintendent to designate a
1717 homeschooled student as a habitual truant and report the student to an
1818 intake officer of the juvenile court or the department of child services
1919 and the prosecuting attorney under certain conditions. Requires a
2020 superintendent to provide the parent of a homeschooled student with
2121 a notice of compulsory attendance violation under certain conditions.

3838 A BILL FOR AN ACT to amend the Indiana Code concerning
3939 education.
4040 Be it enacted by the General Assembly of the State of Indiana:
4141 1 SECTION 1. IC 20-33-2-48 IS ADDED TO THE INDIANA CODE
4242 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
4343 3 1, 2025]: Sec. 48. (a) This section applies to:
4444 4 (1) the parent of a homeschooled student; and
4545 5 (2) the homeschooled student.
4646 6 (b) As used in this section, "chronically absent" refers to a
4747 7 student who:
4848 8 (1) is enrolled in a public school; and
4949 9 (2) has missed at least ten percent (10%) of the school days in
5050 10 a school year, including excused and unexcused absences.
5151 11 (c) As used in this section, to "homeschool" a student refers to
5252 12 educating the student at a nonaccredited, nonpublic school with
5353 13 less than one (1) employee in which the parent of the student
5454 14 provides the student with instruction equivalent to that given in
5555 15 public schools as permitted under section 28 of this chapter.
5656 16 (d) As used in this section, "progress report" refers to a
5757 17 thorough, documented report that contains evidence of a

5959 1 homeschooled student's:
6060 2 (1) school work completion; and
6161 3 (2) learning progress.
6262 4 (e) As used in this section, "school of origin" refers to a public
6363 5 school from which a student withdrew in order to be
6464 6 homeschooled.
6565 7 (f) If the parent of a student who is chronically absent
6666 8 withdraws the student from a public school to homeschool the
6767 9 student, the parent must do the following:
6868 10 (1) Present a thorough plan to the school of origin regarding
6969 11 the curriculum and courses the homeschooled student will
7070 12 complete while homeschooled.
7171 13 (2) Meet with the superintendent of the school of origin not
7272 14 less than two (2) times each semester for the first full school
7373 15 year in which the student is homeschooled to provide a
7474 16 progress report.
7575 17 (3) Meet with the superintendent of the school of origin not
7676 18 less than two (2) times annually for each school year
7777 19 subsequent to the school year described in subdivision (2) to
7878 20 submit a progress report.
7979 21 (g) If the parent of a homeschooled student fails to present a
8080 22 progress report as required under subsection (f)(2) or (f)(3) or
8181 23 presents a progress report that, as determined by the
8282 24 superintendent, does not contain sufficient evidence of progress,
8383 25 the superintendent shall do the following:
8484 26 (1) Designate the homeschooled student as a habitual truant
8585 27 and report the student to:
8686 28 (A) an intake officer of the juvenile court or the
8787 29 department of child services as required under section 25
8888 30 of this chapter; and
8989 31 (B) the prosecuting attorney as required under section 26
9090 32 of this chapter.
9191 33 (2) Provide the parent of the student with a notice of
9292 34 compulsory attendance violation as required under section 27
9393 35 of this chapter.
