Requires a parent who withdraws the parent's chronically absent child from a public school in order to homeschool the child to: (1) present to the school from which the child is withdrawing a plan regarding the curriculum and courses the child will complete while homeschooled; (2) meet with the superintendent of the school from which the child is withdrawing not less than two times each semester for the first full school year in which the student is homeschooled to provide a progress report; and (3) meet with the superintendent not less than two times annually for each subsequent school year. Requires a superintendent to designate a homeschooled student as a habitual truant and report the student to an intake officer of the juvenile court or the department of child services and the prosecuting attorney under certain conditions. Requires a superintendent to provide the parent of a homeschooled student with a notice of compulsory attendance violation under certain conditions. Effective: July 1, 2025. SENATE BILL No. 483 A BILL FOR AN ACT to amend the Indiana Code concerning education. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 20-33-2-48 IS ADDED TO THE INDIANA CODE 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 3 1, 2025]: Sec. 48. (a) This section applies to: 4 (1) the parent of a homeschooled student; and 5 (2) the homeschooled student. 6 (b) As used in this section, "chronically absent" refers to a 7 student who: 8 (1) is enrolled in a public school; and 9 (2) has missed at least ten percent (10%) of the school days in 10 a school year, including excused and unexcused absences. 11 (c) As used in this section, to "homeschool" a student refers to 12 educating the student at a nonaccredited, nonpublic school with 13 less than one (1) employee in which the parent of the student 14 provides the student with instruction equivalent to that given in 15 public schools as permitted under section 28 of this chapter. 16 (d) As used in this section, "progress report" refers to a 17 thorough, documented report that contains evidence of a 2025 IN 483—LS 7234/DI 143 2 1 homeschooled student's: 2 (1) school work completion; and 3 (2) learning progress. 4 (e) As used in this section, "school of origin" refers to a public 5 school from which a student withdrew in order to be 6 homeschooled. 7 (f) If the parent of a student who is chronically absent 8 withdraws the student from a public school to homeschool the 9 student, the parent must do the following: 10 (1) Present a thorough plan to the school of origin regarding 11 the curriculum and courses the homeschooled student will 12 complete while homeschooled. 13 (2) Meet with the superintendent of the school of origin not 14 less than two (2) times each semester for the first full school 15 year in which the student is homeschooled to provide a 16 progress report. 17 (3) Meet with the superintendent of the school of origin not 18 less than two (2) times annually for each school year 19 subsequent to the school year described in subdivision (2) to 20 submit a progress report. 21 (g) If the parent of a homeschooled student fails to present a 22 progress report as required under subsection (f)(2) or (f)(3) or 23 presents a progress report that, as determined by the 24 superintendent, does not contain sufficient evidence of progress, 25 the superintendent shall do the following: 26 (1) Designate the homeschooled student as a habitual truant 27 and report the student to: 28 (A) an intake officer of the juvenile court or the 29 department of child services as required under section 25 30 of this chapter; and 31 (B) the prosecuting attorney as required under section 26 32 of this chapter. 33 (2) Provide the parent of the student with a notice of 34 compulsory attendance violation as required under section 27 35 of this chapter. 2025 IN 483—LS 7234/DI 143
