66 AN ACT concerning controlled substances; adding and removing certain
77 substances in schedules I, II, IV and V of the uniform controlled
88 substances act; making conforming changes to the criminal code
99 definition of fentanyl-related controlled substances; amending K.S.A.
1010 21-5701 and K.S.A. 2023 Supp. 65-4105, 65-4107, 65-4111 and 65-
1111 4113 and repealing the existing sections.
1212 Be it enacted by the Legislature of the State of Kansas:
1313 Section 1. K.S.A. 21-5701 is hereby amended to read as follows: 21-
1414 5701. As used in K.S.A. 21-5701 through 21-5717, and amendments
1515 thereto:
1616 (a) "Controlled substance" means any drug, substance or immediate
1717 precursor included in any of the schedules designated in K.S.A. 65-4105,
1818 65-4107, 65-4109, 65-4111 and 65-4113, and amendments thereto.
1919 (b) (1) "Controlled substance analog" means a substance that is
2020 intended for human consumption, and at least one of the following:
2121 (A) The chemical structure of the substance is substantially similar to
2222 the chemical structure of a controlled substance listed in or added to the
2323 schedules designated in K.S.A. 65-4105 or 65-4107, and amendments
2424 thereto;
2525 (B) the substance has a stimulant, depressant or hallucinogenic effect
2626 on the central nervous system substantially similar to the stimulant,
2727 depressant or hallucinogenic effect on the central nervous system of a
2828 controlled substance included in the schedules designated in K.S.A. 65-
2929 4105 or 65-4107, and amendments thereto; or
3030 (C) with respect to a particular individual, such individual represents
3131 or intends the substance to have a stimulant, depressant or hallucinogenic
3232 effect on the central nervous system substantially similar to the stimulant,
3333 depressant or hallucinogenic effect on the central nervous system of a
3434 controlled substance included in the schedules designated in K.S.A. 65-
3535 4105 or 65-4107, and amendments thereto.
3636 (2) "Controlled substance analog" does not include:
3737 (A) A controlled substance;
3838 (B) a substance for which there is an approved new drug application;

7575 (C) a substance with respect to which an exemption is in effect for
7676 investigational use by a particular person under section 505 of the federal
7777 food, drug, and cosmetic act, 21 U.S.C. § 355, to the extent conduct with
7878 respect to the substance is permitted by the exemption.
7979 (c) "Cultivate" means the planting or promotion of growth of five or
8080 more plants that contain or can produce controlled substances.
8181 (d) "Distribute" means the actual, constructive or attempted transfer
8282 from one person to another of some item whether or not there is an agency
8383 relationship. "Distribute" includes, but is not limited to, sale, offer for sale
8484 or any act that causes some item to be transferred from one person to
8585 another. "Distribute" does not include acts of administering, dispensing or
8686 prescribing a controlled substance as authorized by the pharmacy act of the
8787 state of Kansas, the uniform controlled substances act or otherwise
8888 authorized by law.
8989 (e) (1) "Drug" means:
9090 (A) Substances recognized as drugs in the official United States
9191 pharmacopeia, official homeopathic pharmacopoeia of the United States or
9292 official national formulary or any supplement to any of them;
9393 (B) substances intended for use in the diagnosis, cure, mitigation,
9494 treatment or prevention of disease in humans or animals;
9595 (C) substances, other than food, intended to affect the structure or any
9696 function of the body of humans or animals; and
9797 (D) substances intended for use as a component of any article
9898 specified in subparagraph (A), (B) or (C).
9999 (2) "Drug" does not include devices or their components, parts or
100100 accessories.
101101 (f) (1) "Drug paraphernalia" means all equipment and materials of
102102 any kind that are used, or primarily intended or designed for use in
103103 planting, propagating, cultivating, growing, harvesting, manufacturing,
104104 compounding, converting, producing, processing, preparing, testing,
105105 analyzing, packaging, repackaging, storing, containing, concealing,
106106 injecting, ingesting, inhaling or otherwise introducing into the human body
107107 a controlled substance and in violation of this act.
108108 (2) "Drug paraphernalia" includes, but is not limited to:
109109 (A) Kits used or intended for use in planting, propagating, cultivating,
110110 growing or harvesting any species of plant that is a controlled substance or
111111 from which a controlled substance can be derived;
112112 (B) kits used or intended for use in manufacturing, compounding,
113113 converting, producing, processing or preparing controlled substances;
114114 (C) isomerization devices used or intended for use in increasing the
115115 potency of any species of plant that is a controlled substance;
116116 (D) testing equipment used or intended for use in identifying or in
117117 analyzing the strength, effectiveness or purity of controlled substances;

161161 (E) scales and balances used or intended for use in weighing or
162162 measuring controlled substances;
163163 (F) diluents and adulterants, including, but not limited to, quinine
164164 hydrochloride, mannitol, mannite, dextrose and lactose that are used or
165165 intended for use in cutting controlled substances;
166166 (G) separation gins and sifters used or intended for use in removing
167167 twigs and seeds from or otherwise cleaning or refining marijuana;
168168 (H) blenders, bowls, containers, spoons and mixing devices used or
169169 intended for use in compounding controlled substances;
170170 (I) capsules, balloons, envelopes, bags and other containers used or
171171 intended for use in packaging small quantities of controlled substances;
172172 (J) containers and other objects used or intended for use in storing or
173173 concealing controlled substances;
174174 (K) hypodermic syringes, needles and other objects used or intended
175175 for use in parenterally injecting controlled substances into the human
176176 body;
177177 (L) objects used or primarily intended or designed for use in
178178 ingesting, inhaling or otherwise introducing marijuana, cocaine, hashish,
179179 hashish oil, phencyclidine (PCP), methamphetamine or amphetamine into
180180 the human body, such as:
181181 (i) Metal, wooden, acrylic, glass, stone, plastic or ceramic pipes with
182182 or without screens, permanent screens, hashish heads or punctured metal
183183 bowls;
184184 (ii) water pipes, bongs or smoking pipes designed to draw smoke
185185 through water or another cooling device;
186186 (iii) carburetion pipes, glass or other heat-resistant tubes or any other
187187 device used, intended to be used or designed to be used to cause
188188 vaporization of a controlled substance for inhalation;
189189 (iv) smoking and carburetion masks;
190190 (v) roach clips, objects used to hold burning material, such as a
191191 marijuana cigarette, that has become too small or too short to be held in
192192 the hand;
193193 (vi) miniature cocaine spoons and cocaine vials;
194194 (vii) chamber smoking pipes;
195195 (viii) carburetor smoking pipes;
196196 (ix) electric smoking pipes;
197197 (x) air-driven smoking pipes;
198198 (xi) chillums;
199199 (xii) bongs;
200200 (xiii) ice pipes or chillers;
201201 (xiv) any smoking pipe manufactured to disguise its intended
202202 purpose;
203203 (xv) wired cigarette papers; or

248248 (3) "Drug paraphernalia" does not include:
249249 (A) Any products, chemicals or materials described in K.S.A. 21-
250250 5709(a), and amendments thereto; or
251251 (B) any materials used or intended for use to test a substance for the
252252 presence of fentanyl, a fentanyl analog, ketamine or gamma
253253 hydroxybutyric acid.
254254 (g) "Fentanyl-related controlled substance" means any substance
255255 designated in K.S.A. 65-4105(b)(1), (b)(2), (b)(4), (b)(10), (b)(11), (b)
256256 (12), (b)(14), (b)(15), (b)(16), (b)(17), (b)(20), (b)(21), (b)(22), (b)(23),
257257 (b)(24), (b)(26), (b)(27), (b)(28), (b)(35)(b)(37), (b)(41), (b)(42), (b)(43),
258258 (b)(44), (b)(45), (b)(46), (b)(47), (b)(49) (b)(48), (b)(50), (b)(54), (b)(55),
259259 (b)(56), (b)(57), (b)(58), (b)(59), (b)(60), (b)(61), (b)(62) (b)(68), (b)(70),
260260 (b)(71), (b)(72), (b)(73), (b)(74), (b)(75), (b)(76), (b)(77), (b)(78), (b)(79),
261261 (b)(80), (b)(81), (b)(82), (b)(83), (b)(84), (b)(85), (b)(91), (b)(97), (b)(98),
262262 (b)(99), (b)(103), (b)(104), (g)(1) or (g)(2) or 65-4107(c)(1), (c)(6), (c)(9),

265265 (h) "Immediate precursor" means a substance that the state board of
266266 pharmacy has found to be and by rules and regulations designates as being
267267 the principal compound commonly used or produced primarily for use and
268268 that is an immediate chemical intermediary used or likely to be used in the
269269 manufacture of a controlled substance, the control of which is necessary to
270270 prevent, curtail or limit manufacture.
271271 (i) "Isomer" means all enantiomers and diastereomers.
272272 (j) "Manufacture" means the production, preparation, propagation,
273273 compounding, conversion or processing of or placing into pill or capsule
274274 form a controlled substance either directly or indirectly or by extraction
275275 from substances of natural origin or independently by means of chemical
276276 synthesis or by a combination of extraction and chemical synthesis.
277277 "Manufacture" does not include:
278278 (1) The preparation or compounding of a controlled substance by an
279279 individual for the individual's own lawful use or the preparation,
280280 compounding, packaging or labeling of a controlled substance:
281281 (A) By a practitioner or the practitioner's agent pursuant to a lawful
282282 order of a practitioner as an incident to the practitioner's administering or
283283 dispensing of a controlled substance in the course of the practitioner's
284284 professional practice; or
285285 (B) by a practitioner or by the practitioner's authorized agent under
286286 such practitioner's supervision for the purpose of or as an incident to
287287 research, teaching or chemical analysis or by a pharmacist or medical care
288288 facility as an incident to dispensing of a controlled substance; or
289289 (2) the addition of diluents or adulterants, including, but not limited

333333 to, quinine hydrochloride, mannitol, mannite, dextrose or lactose that are
334334 intended for use in cutting a controlled substance.
335335 (k) "Marijuana" means all parts of all varieties of the plant Cannabis
336336 whether growing or not, the seeds thereof, the resin extracted from any
337337 part of the plant and every compound, manufacture, salt, derivative,
338338 mixture or preparation of the plant, its seeds or resin. "Marijuana" does not
339339 include:
340340 (1) The mature stalks of the plant, fiber produced from the stalks, oil
341341 or cake made from the seeds of the plant, any other compound,
342342 manufacture, salt, derivative, mixture or preparation of the mature stalks,
343343 except the resin extracted therefrom, fiber, oil or cake or the sterilized seed
344344 of the plant that is incapable of germination;
345345 (2) any substance listed in schedules II through V of the uniform
346346 controlled substances act;
347347 (3) drug products approved by the United States food and drug
348348 administration as of the effective date of this act;
349349 (4) cannabidiol (other trade name: 2-[(3-methyl-6-(1-methylethenyl)-
350350 2-cyclohexen-1-yl]-5-pentyl-1,3-benzenediol); or
351351 (5) industrial hemp as defined in K.S.A. 2-3901, and amendments
352352 thereto, when cultivated, produced, possessed or used for activities
353353 authorized by the commercial industrial hemp act.
354354 (l) "Minor" means a person under 18 years of age.
355355 (m) "Narcotic drug" means any of the following whether produced
356356 directly or indirectly by extraction from substances of vegetable origin or
357357 independently by means of chemical synthesis or by a combination of
358358 extraction and chemical synthesis:
359359 (1) Opium and opiate and any salt, compound, derivative or
360360 preparation of opium or opiate;
361361 (2) any salt, compound, isomer, derivative or preparation thereof that
362362 is chemically equivalent or identical with any of the substances referred to
363363 in paragraph (1) but not including the isoquinoline alkaloids of opium;
364364 (3) opium poppy and poppy straw;
365365 (4) coca leaves and any salt, compound, derivative or preparation of
366366 coca leaves and any salt, compound, isomer, derivative or preparation
367367 thereof that is chemically equivalent or identical with any of these
368368 substances, but not including decocainized coca leaves or extractions of
369369 coca leaves that do not contain cocaine or ecgonine.
370370 (n) "Opiate" means any substance having an addiction-forming or
371371 addiction-sustaining liability similar to morphine or being capable of
372372 conversion into a drug having addiction-forming or addiction-sustaining
373373 liability. "Opiate" does not include, unless specifically designated as
374374 controlled under K.S.A. 65-4102, and amendments thereto, the
375375 dextrorotatory isomer of 3-methoxy-n-methylmorphinan and its salts

419419 (dextromethorphan). "Opiate" does include its racemic and levorotatory
420420 forms.
421421 (o) "Opium poppy" means the plant of the species Papaver
422422 somniferum l. except its seeds.
423423 (p) "Person" means an individual, corporation, government or
424424 governmental subdivision or agency, business trust, estate, trust,
425425 partnership, association or any other legal entity.
426426 (q) "Poppy straw" means all parts, except the seeds, of the opium
427427 poppy, after mowing.
428428 (r) "School property" means property upon which is located a
429429 structure used by a unified school district or an accredited nonpublic
430430 school for student instruction or attendance or extracurricular activities of
431431 pupils enrolled in kindergarten or any of the grades one through 12. This
432432 definition shall not be construed as requiring that school be in session or
433433 that classes are actually being held at the time of the offense or that
434434 children must be present within the structure or on the property during the
435435 time of any alleged criminal act. If the structure or property meets the
436436 above definition, the actual use of that structure or property at the time
437437 alleged shall not be a defense to the crime charged or the sentence
438438 imposed.
439439 (s) "Simulated controlled substance" means any product that
440440 identifies itself by a common name or slang term associated with a
441441 controlled substance and that indicates on its label or accompanying
442442 promotional material that the product simulates the effect of a controlled
443443 substance.
444444 Sec. 2. K.S.A. 2023 Supp. 65-4105 is hereby amended to read as
445445 follows: 65-4105. (a) The controlled substances listed in this section are
446446 included in schedule I and the number set forth opposite each drug or
447447 substance is the DEA controlled substances code that has been assigned to
448448 it.
449449 (b) Any of the following opiates, including their isomers, esters,
450450 ethers, salts, and salts of isomers, esters and ethers, unless specifically
451451 excepted, whenever the existence of these isomers, esters, ethers and salts
452452 is possible within the specific chemical designation:
453453 (1) Acetyl fentanyl
