66 AN ACT concerning education; requiring public schools and public
77 postsecondary educational institutions to make menstrual products
88 available at no cost to students; establishing a state grant program to
99 reimburse schools and institutions for such costs.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. (a) As used in this section:
1212 (1) "Charter school" means the same as defined in K.S.A. 72-4206,
1313 and amendments thereto.
1414 (2) "Menstrual products" means tampons and sanitary napkins for use
1515 in connection with the menstrual cycle that conform with applicable
1616 industry standards.
1717 (3) "Postsecondary educational institution" means the same as
1818 defined in K.S.A. 74-3201b, and amendments thereto.
1919 (4) "School district" means the same as defined in K.S.A. 72-5132,
2020 and amendments thereto.
2121 (b) Each school of a school district or charter school in this state with
2222 grades five and below shall make menstrual products available, at no cost
2323 to students, in at least one neutral location that is easily accessible to all
2424 students and that does not stigmatize any student seeking such products,
2525 such as a school nurse's office or administrative office, as appropriate.
2626 (c) Each school of a school district or charter school in this state with
2727 any of the grades six through 12 shall make menstrual products available
2828 in easily accessible locations, at no cost to students, that does not
2929 stigmatize any student seeking such products, including in restrooms.
3030 Menstrual products shall be made available in all female, gender-neutral
3131 and standalone handicapped restrooms accessed by students in any of the
3232 grades six through 12, as well as a neutral location, such as a school
3333 nurse's office or administrative office, as appropriate.
3434 (d) Each postsecondary educational institution in this state shall make
3535 menstrual products available, at no cost to students, at no fewer than one
3636 neutral and accessible location to all students that does not stigmatize any
3737 student seeking such products.
3838 (1) For purposes of this section, a location's accessibility shall be
3939 determined by considering all of, but not limiting consideration to, the

7575 following factors:
7676 (A) Hours of operation, relative to hours that students are on campus;
7777 (B) proximity to high-traffic areas on campus;
7878 (C) accessibility by students of all genders and regardless of physical
7979 ability;
8080 (D) privacy, including whether accessing products would require
8181 interaction with staff or other students; and
8282 (E) safety.
8383 (2) Locations described in this subsection may include student
8484 centers, libraries, wellness or health centers, pantries and study rooms.
8585 (3) Each postsecondary educational institution shall post a notice
8686 regarding the requirements of this section in a prominent and conspicuous
8787 location in all women's restrooms, standalone handicapped restrooms and
8888 gender-neutral restrooms and in at least one men's restroom.
8989 (e) (1) Sufficient moneys shall be appropriated by the legislature to
9090 the state department of education and to the state board of regents for the
9191 purpose of providing menstrual products at no cost to students in each
9292 school of a school district, charter school and postsecondary educational
9393 institution.
9494 (2) Subject to appropriations, the state department of education shall
9595 reimburse each school district for actual costs incurred in implementing
9696 this act.
9797 (3) Subject to appropriations, the state board of regents shall
9898 reimburse each postsecondary educational institution for actual costs
9999 incurred in implementing this act.
100100 (4) Actual costs incurred may only include the following:
101101 (A) Menstrual products;
102102 (B) menstrual product dispensers; and
103103 (C) menstrual product dispenser installation costs.
104104 (f) (1) The state board of education shall adopt any rules and
105105 regulations necessary for the administration of this act. Such rules and
106106 regulations shall provide for an application process for school districts to
107107 be reimbursed for actual costs incurred.
108108 (2) The state board of regents shall adopt any rules and regulations
109109 necessary for the administration of this act. Such rules and regulations
110110 shall provide for an application process for postsecondary educational
111111 institutions to be reimbursed for costs incurred.
112112 (g) (1) On or before June 1 of each year, each school district and
113113 postsecondary educational institution shall produce a report containing:
114114 (A) The number of menstrual products purchased that year;
115115 (B) the number of menstrual products actually distributed to students
116116 that year; and
117117 (C) any grievances or other complaints about lack of access to or

162162 (2) Such reports shall be made available for public inspection.
163163 Sec. 2. This act shall take effect and be in force from and after its
164164 publication in the statute book.
