AN ACT concerning education; requiring public schools and public 
postsecondary educational institutions to make menstrual products 
available at no cost to students; establishing a state grant program to 
reimburse schools and institutions for such costs.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) As used in this section:
(1) "Charter school" means the same as defined in K.S.A. 72-4206, 
and amendments thereto.
(2) "Menstrual products" means tampons and sanitary napkins for use 
in connection with the menstrual cycle that conform with applicable 
industry standards.
(3) "Postsecondary educational institution" means the same as 
defined in K.S.A. 74-3201b, and amendments thereto.
(4) "School district" means the same as defined in K.S.A. 72-5132, 
and amendments thereto.
(b) Each school of a school district or charter school in this state with 
grades five and below shall make menstrual products available, at no cost 
to students, in at least one neutral location that is easily accessible to all 
students and that does not stigmatize any student seeking such products, 
such as a school nurse's office or administrative office, as appropriate.
(c) Each school of a school district or charter school in this state with 
any of the grades six through 12 shall make menstrual products available 
in easily accessible locations, at no cost to students, that does not 
stigmatize any student seeking such products, including in restrooms. 
Menstrual products shall be made available in all female, gender-neutral 
and standalone handicapped restrooms accessed by students in any of the 
grades six through 12, as well as a neutral location, such as a school 
nurse's office or administrative office, as appropriate.
(d) Each postsecondary educational institution in this state shall make 
menstrual products available, at no cost to students, at no fewer than one 
neutral and accessible location to all students that does not stigmatize any 
student seeking such products.
(1) For purposes of this section, a location's accessibility shall be 
determined by considering all of, but not limiting consideration to, the

following factors:
(A) Hours of operation, relative to hours that students are on campus;
(B) proximity to high-traffic areas on campus;
(C) accessibility by students of all genders and regardless of physical 
ability;
(D) privacy, including whether accessing products would require 
interaction with staff or other students; and
(E) safety.
(2) Locations described in this subsection may include student 
centers, libraries, wellness or health centers, pantries and study rooms.
(3) Each postsecondary educational institution shall post a notice 
regarding the requirements of this section in a prominent and conspicuous 
location in all women's restrooms, standalone handicapped restrooms and 
gender-neutral restrooms and in at least one men's restroom.
(e) (1) Sufficient moneys shall be appropriated by the legislature to 
the state department of education and to the state board of regents for the 
purpose of providing menstrual products at no cost to students in each 
school of a school district, charter school and postsecondary educational 
institution.
(2) Subject to appropriations, the state department of education shall 
reimburse each school district for actual costs incurred in implementing 
this act.
(3) Subject to appropriations, the state board of regents shall 
reimburse each postsecondary educational institution for actual costs 
incurred in implementing this act.
(4) Actual costs incurred may only include the following:
(A) Menstrual products;
(B) menstrual product dispensers; and
(C) menstrual product dispenser installation costs.
(f) (1) The state board of education shall adopt any rules and 
regulations necessary for the administration of this act. Such rules and 
regulations shall provide for an application process for school districts to 
be reimbursed for actual costs incurred.
(2) The state board of regents shall adopt any rules and regulations 
necessary for the administration of this act. Such rules and regulations 
shall provide for an application process for postsecondary educational 
institutions to be reimbursed for costs incurred.
(g) (1) On or before June 1 of each year, each school district and 
postsecondary educational institution shall produce a report containing:
(A) The number of menstrual products purchased that year;
(B) the number of menstrual products actually distributed to students 
that year; and
(C) any grievances or other complaints about lack of access to or

quality of menstrual products.
(2) Such reports shall be made available for public inspection.
Sec. 2. This act shall take effect and be in force from and after its 
publication in the statute book.
