55 AN ACT concerning certain state officers; relating to the salaries of the
66 governor, lieutenant governor, attorney general, secretary of state, state
77 treasurer, commissioner of insurance, justices of the supreme court,
88 judges of the court of appeals and members of the governor's cabinet;
99 establishing the rate of pay for such state officers based on the annual
1010 rate of pay for members of congress, as adjusted by the provisions of
1111 this act; providing that all such rates of pay are subject to
1212 appropriations; amending K.S.A. 40-102, 75-3103 and 75-3120l and
1313 repealing the existing sections; also repealing K.S.A. 75-3101, 75-
1414 3104, 75-3108, 75-3110, 75-3111a, 75-3120f and 75-3120h.
1515 Be it enacted by the Legislature of the State of Kansas:
1616 New Section 1. (a) Subject to appropriations, on July 1, 2023, and
1717 each July 1 thereafter, the governor and the attorney general shall receive
1818 for services an annual salary equal to the amount of annual rate of pay for
1919 a member of congress of the United States, not in a leadership role, on
2020 such date plus 10% of such congressional annual rate of pay.
2121 (b) Subject to appropriations and except as provided further, on July
2222 1, 2023, and each July 1 thereafter: (1) The secretary of state, state
2323 treasurer, commissioner of insurance, justices of the supreme court and
2424 judges of the court of appeals shall receive for services an annual salary
2525 equal to the amount of annual rate of pay for a member of congress of the
2626 United States, not in a leadership role, on such date; and
2727 (2) the chief justice of the supreme court and chief judge of the court
2828 of appeals shall receive for services an annual salary equal to the amount
2929 of annual rate of pay for a member of congress of the United States, not in
3030 a leadership role, on such date plus 2.5% of such congressional annual rate
3131 of pay.
3232 (c) If for any reason such congressional salary is decreased, the
3333 salaries established in this section shall remain the same for the next
3434 ensuing fiscal year unless diminished by general law applicable to all
3535 salaried officers of the state.
3636 New Sec. 2. (a) Subject to appropriations, on July 1, 2023, and each
3737 July 1 thereafter, the minimum amount of annual salary the members of

7878 (b) For the purposes of this section, the members of the governor's
7979 cabinet shall be determined by the governor.
8080 Sec. 3. K.S.A. 40-102 is hereby amended to read as follows: 40-102.
8181 There is hereby established a department to be known as the insurance
8282 department, which shall have a chief officer entitled the commissioner of
8383 insurance who shall receive, except as otherwise provided in K.S.A. 75-
8484 3111a, and amendments thereto, a salary at a biweekly pay rate of
8585 $3,307.81, and such officer. The commissioner of insurance shall be
8686 charged with the administration of all laws relating to insurance, insurance
8787 companies and fraternal benefit societies doing business in this state, and
8888 all other duties which are or may be imposed upon such officer by law.
8989 Sec. 4. K.S.A. 75-3103 is hereby amended to read as follows: 75-
9090 3103. (a) The lieutenant governor shall receive, as reimbursement for
9191 expenses the following: (1) Biweekly the sum of $76.91, except as
9292 otherwise provided in subsection (c), and (2) when attending the duties of
9393 office or attending any authorized meeting, in addition to other provisions
9494 of this section, travel expenses and subsistence expenses and allowances in
9595 amounts equal to those provided for by K.S.A. 75-3212, and amendments
9696 thereto.
9797 (b) In addition to any other compensation provided by law and except
9898 as otherwise provided in K.S.A. 75-3111a, and amendments thereto, the
9999 lieutenant governor shall also receive for services in the performance of
100100 duties imposed by law compensation at the biweekly pay rate of $1,204.35

104104 rate of pay for a member of congress of the United States, not in a
105105 leadership role, on such date. While acting as governor, the lieutenant
106106 governor shall receive the same salary as the governor. The lieutenant
107107 governor may appoint an administrative assistant and other office and
108108 stenographic employees, all of whom shall be in the unclassified service of
109109 the Kansas civil service act. Such administrative assistant shall receive
110110 travel expenses and subsistence expenses or allowances as provided by
111111 K.S.A. 75-3212, and amendments thereto, when traveling as authorized by
112112 the lieutenant governor.
113113 (b)(c) If the lieutenant governor is appointed by the governor under
114114 the provision of K.S.A. 75-303, and amendments thereto, the lieutenant
115115 governor shall receive a salary to be fixed by the governor or a salary as
116116 provided for in subsection (a) of this section, whichever is greater.
117117 (c) Whenever the rates of compensation of the pay plan for persons in
118118 the classified service under the Kansas civil service act are increased for
119119 payroll periods chargeable to fiscal years commencing after June 30, 2009,
120120 the sum provided biweekly for reimbursement of expenses pursuant to

164164 subsection (a)(1) for the lieutenant governor shall be increased on the
165165 effective date of any such pay plan increase by an amount computed by
166166 multiplying the average of the percentage increases in all steps of such pay
167167 plan by the biweekly sum provided to the lieutenant governor for
168168 reimbursement of expenses as authorized by this section.
169169 Sec. 5. K.S.A. 75-3120l is hereby amended to read as follows: 75-
170170 3120l. (a) Whenever the rates of compensation of the pay plan for persons
171171 in the classified service under the Kansas civil service act are increased for
172172 payroll periods chargeable to fiscal years commencing after June 30, 1993
173173 2023, the annual salary of the chief justice of the supreme court, each other
174174 justice of the supreme court, the chief judge of the court of appeals, each
175175 other judge of the court of appeals, each district judge and each district
176176 magistrate judge shall be increased by an amount, adjusted to the nearest
177177 dollar, computed by multiplying the average of the percentage increases in
178178 all monthly steps of such pay plan by the annual salary of the justice or
179179 judge which that is being received as provided by law and which is in
180180 effect prior to the effective date of such increase in the rates of
181181 compensation of the pay plan for persons in the classified service under
182182 the Kansas civil service act.
183183 (b) If increases in the monthly rates of compensation from step
184184 movements of the pay plan for persons in the classified service under the
185185 Kansas civil service act are authorized for the fiscal year ending June 30,
186186 1995, or any fiscal year thereafter, the annual salary of the chief justice of
187187 the supreme court, each other justice of the supreme court, the chief judge
188188 of the court of appeals, each other judge of the court of appeals, each
189189 district judge and each district magistrate judge shall be increased by an
190190 amount, adjusted to the nearest dollar, computed by multiplying the
191191 average percentage increase in the monthly rate of compensation from step
192192 movements on the pay plan for persons in the classified service under the
193193 Kansas civil service act determined under subsection (c) by the annual
194194 salary of the justice or judge which is being received as provided by law
195195 and which is in effect prior to the effective date of such increase. The
196196 increase in the annual salary of each justice or judge pursuant to this
197197 subsection shall take effect on the first day of the first payroll period which
198198 is chargeable to the fiscal year in which such step movements on the pay
199199 plan are authorized to take effect.
200200 (c) For purposes of subsection (b), the average percentage increase in
201201 the monthly rate of compensation from step movements on the pay plan
202202 for persons in the classified service under the Kansas civil service act shall
203203 be equal to the percentage certified by the secretary of administration
204204 which equals the estimated average of the percentage increases in all
205205 monthly rates of compensation from step movements on the pay plan for
206206 persons in the classified service under the Kansas civil service act which

250250 are authorized to take effect during the fiscal year in which such step
251251 movements on the pay plan are authorized to take effect.
252252 (d) If the increase under subsection (a) takes effect on the first day of
253253 the first payroll period of the fiscal year, the percentage rate increases
254254 determined under subsections (a) and (b) shall be added together and such
255255 aggregate percentage increase of compensation under this section shall be
256256 used to increase the rate of compensation of each justice or judge instead
257257 of applying the increases under subsections (a) and (b) separately.
258258 (e) The provisions of this section shall not apply to the annual salary
259259 of any district judge nor the salary of any magistrate judge for any payroll
260260 period chargeable to the fiscal year ending June 30, 2007. The provisions
261261 of this section shall apply to the annual salary of each district judge or
262262 magistrate judge for payroll periods chargeable to fiscal years
263263 commencing after June 30, 2007.
264264 Sec. 6. K.S.A. 40-102, 75-3101, 75-3103, 75-3104, 75-3108, 75-
265265 3110, 75-3111a, 75-3120f, 75-3120h and 75-3120l are hereby repealed.
266266 Sec. 7. This act shall take effect and be in force from and after its
267267 publication in the Kansas register.
