5	5	AN ACT concerning certain state officers; relating to the salaries of the
6	6	governor, lieutenant governor, attorney general, secretary of state, state
7	7	treasurer, commissioner of insurance, justices of the supreme court,
8	8	judges of the court of appeals and members of the governor's cabinet;
9	9	establishing the rate of pay for such state officers based on the annual
10	10	rate of pay for members of congress, as adjusted by the provisions of
11	11	this act; providing that all such rates of pay are subject to
12	12	appropriations; amending K.S.A. 40-102, 75-3103 and 75-3120l and
13	13	repealing the existing sections; also repealing K.S.A. 75-3101, 75-
14	14	3104, 75-3108, 75-3110, 75-3111a, 75-3120f and 75-3120h.
15	15	Be it enacted by the Legislature of the State of Kansas:
16	16	New Section 1. (a) Subject to appropriations, on July 1, 2023, and
17	17	each July 1 thereafter, the governor and the attorney general shall receive
18	18	for services an annual salary equal to the amount of annual rate of pay for
19	19	a member of congress of the United States, not in a leadership role, on
20	20	such date plus 10% of such congressional annual rate of pay.
21	21	(b) Subject to appropriations and except as provided further, on July
22	22	1, 2023, and each July 1 thereafter: (1) The secretary of state, state
23	23	treasurer, commissioner of insurance, justices of the supreme court and
24	24	judges of the court of appeals shall receive for services an annual salary
25	25	equal to the amount of annual rate of pay for a member of congress of the
26	26	United States, not in a leadership role, on such date; and
27	27	(2) the chief justice of the supreme court and chief judge of the court
28	28	of appeals shall receive for services an annual salary equal to the amount
29	29	of annual rate of pay for a member of congress of the United States, not in
30	30	a leadership role, on such date plus 2.5% of such congressional annual rate
31	31	of pay.
32	32	(c) If for any reason such congressional salary is decreased, the
33	33	salaries established in this section shall remain the same for the next
34	34	ensuing fiscal year unless diminished by general law applicable to all
35	35	salaried officers of the state.
36	36	New Sec. 2. (a) Subject to appropriations, on July 1, 2023, and each
37	37	July 1 thereafter, the minimum amount of annual salary the members of
38	38	the governor's cabinet shall receive for services shall be equal to the
39	39	amount of annual rate of pay for a member of congress of the United

77	77	congressional annual rate of pay.
78	78	(b) For the purposes of this section, the members of the governor's
79	79	cabinet shall be determined by the governor.
80	80	Sec. 3. K.S.A. 40-102 is hereby amended to read as follows: 40-102.
81	81	There is hereby established a department to be known as the insurance
82	82	department, which shall have a chief officer entitled the commissioner of
83	83	insurance who shall receive, except as otherwise provided in K.S.A. 75-
84	84	3111a, and amendments thereto, a salary at a biweekly pay rate of
85	85	$3,307.81, and such officer. The commissioner of insurance shall be
86	86	charged with the administration of all laws relating to insurance, insurance
87	87	companies and fraternal benefit societies doing business in this state, and
88	88	all other duties which are or may be imposed upon such officer by law.
89	89	Sec. 4. K.S.A. 75-3103 is hereby amended to read as follows: 75-
90	90	3103. (a) The lieutenant governor shall receive, as reimbursement for
91	91	expenses the following: (1) Biweekly the sum of $76.91, except as
92	92	otherwise provided in subsection (c), and (2) when attending the duties of
93	93	office or attending any authorized meeting, in addition to other provisions
94	94	of this section, travel expenses and subsistence expenses and allowances in
95	95	amounts equal to those provided for by K.S.A. 75-3212, and amendments
96	96	thereto.
97	97	(b) In addition to any other compensation provided by law and except
98	98	as otherwise provided in K.S.A. 75-3111a, and amendments thereto, the
99	99	lieutenant governor shall also receive for services in the performance of
100	100	duties imposed by law compensation at the biweekly pay rate of $1,204.35
101	101	receive for services an annual salary equal to

103	103	/2 of the amount of annual
104	104	rate of pay for a member of congress of the United States, not in a
105	105	leadership role, on such date. While acting as governor, the lieutenant
106	106	governor shall receive the same salary as the governor. The lieutenant
107	107	governor may appoint an administrative assistant and other office and
108	108	stenographic employees, all of whom shall be in the unclassified service of
109	109	the Kansas civil service act. Such administrative assistant shall receive
110	110	travel expenses and subsistence expenses or allowances as provided by
111	111	K.S.A. 75-3212, and amendments thereto, when traveling as authorized by
112	112	the lieutenant governor.
113	113	(b)(c) If the lieutenant governor is appointed by the governor under
114	114	the provision of K.S.A. 75-303, and amendments thereto, the lieutenant
115	115	governor shall receive a salary to be fixed by the governor or a salary as
116	116	provided for in subsection (a) of this section, whichever is greater.
117	117	(c) Whenever the rates of compensation of the pay plan for persons in
118	118	the classified service under the Kansas civil service act are increased for
119	119	payroll periods chargeable to fiscal years commencing after June 30, 2009,
120	120	the sum provided biweekly for reimbursement of expenses pursuant to

164	164	subsection (a)(1) for the lieutenant governor shall be increased on the
165	165	effective date of any such pay plan increase by an amount computed by
166	166	multiplying the average of the percentage increases in all steps of such pay
167	167	plan by the biweekly sum provided to the lieutenant governor for
168	168	reimbursement of expenses as authorized by this section.
169	169	Sec. 5. K.S.A. 75-3120l is hereby amended to read as follows: 75-
170	170	3120l. (a) Whenever the rates of compensation of the pay plan for persons
171	171	in the classified service under the Kansas civil service act are increased for
172	172	payroll periods chargeable to fiscal years commencing after June 30, 1993
173	173	2023, the annual salary of the chief justice of the supreme court, each other
174	174	justice of the supreme court, the chief judge of the court of appeals, each
175	175	other judge of the court of appeals, each district judge and each district
176	176	magistrate judge shall be increased by an amount, adjusted to the nearest
177	177	dollar, computed by multiplying the average of the percentage increases in
178	178	all monthly steps of such pay plan by the annual salary of the justice or
179	179	judge which that is being received as provided by law and which is in
180	180	effect prior to the effective date of such increase in the rates of
181	181	compensation of the pay plan for persons in the classified service under
182	182	the Kansas civil service act.
183	183	(b) If increases in the monthly rates of compensation from step
184	184	movements of the pay plan for persons in the classified service under the
185	185	Kansas civil service act are authorized for the fiscal year ending June 30,
186	186	1995, or any fiscal year thereafter, the annual salary of the chief justice of
187	187	the supreme court, each other justice of the supreme court, the chief judge
188	188	of the court of appeals, each other judge of the court of appeals, each
189	189	district judge and each district magistrate judge shall be increased by an
190	190	amount, adjusted to the nearest dollar, computed by multiplying the
191	191	average percentage increase in the monthly rate of compensation from step
192	192	movements on the pay plan for persons in the classified service under the
193	193	Kansas civil service act determined under subsection (c) by the annual
194	194	salary of the justice or judge which is being received as provided by law
195	195	and which is in effect prior to the effective date of such increase. The
196	196	increase in the annual salary of each justice or judge pursuant to this
197	197	subsection shall take effect on the first day of the first payroll period which
198	198	is chargeable to the fiscal year in which such step movements on the pay
199	199	plan are authorized to take effect.
200	200	(c) For purposes of subsection (b), the average percentage increase in
201	201	the monthly rate of compensation from step movements on the pay plan
202	202	for persons in the classified service under the Kansas civil service act shall
203	203	be equal to the percentage certified by the secretary of administration
204	204	which equals the estimated average of the percentage increases in all
205	205	monthly rates of compensation from step movements on the pay plan for
206	206	persons in the classified service under the Kansas civil service act which

250	250	are authorized to take effect during the fiscal year in which such step
251	251	movements on the pay plan are authorized to take effect.
252	252	(d) If the increase under subsection (a) takes effect on the first day of
253	253	the first payroll period of the fiscal year, the percentage rate increases
254	254	determined under subsections (a) and (b) shall be added together and such
255	255	aggregate percentage increase of compensation under this section shall be
256	256	used to increase the rate of compensation of each justice or judge instead
257	257	of applying the increases under subsections (a) and (b) separately.
258	258	(e) The provisions of this section shall not apply to the annual salary
259	259	of any district judge nor the salary of any magistrate judge for any payroll
260	260	period chargeable to the fiscal year ending June 30, 2007. The provisions
261	261	of this section shall apply to the annual salary of each district judge or
262	262	magistrate judge for payroll periods chargeable to fiscal years
263	263	commencing after June 30, 2007.
264	264	Sec. 6. K.S.A. 40-102, 75-3101, 75-3103, 75-3104, 75-3108, 75-
265	265	3110, 75-3111a, 75-3120f, 75-3120h and 75-3120l are hereby repealed.
266	266	Sec. 7. This act shall take effect and be in force from and after its
267	267	publication in the Kansas register.
