66 AN ACT concerning higher education; providing that tenure at
77 postsecondary educational institutions shall not be defined, awarded or
88 recognized as an entitlement, right or property interest in a faculty
99 member's current, ongoing or future employment by an institution.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. (a) An award of tenure may confer certain benefits,
1212 processes or preferences, but tenure shall be discretionary and conditional
1313 and shall not, nor shall it be interpreted to, create any entitlement, right or
1414 property interest in a faculty member's current, ongoing or future
1515 employment by an institution.
1616 (b) The board of regents and any institution shall not define, award or
1717 otherwise recognize tenure as an entitlement, right or property interest in a
1818 faculty member's current, ongoing or future employment by an institution.
1919 (c) No award of tenure by the board of regents or any institution in
2020 existence on the effective date of this act shall be considered or deemed an
2121 entitlement, right or property interest in a faculty member's current,
2222 ongoing, or future employment by an institution.
2323 (d) Any special benefits, processes or preferences conferred on a
2424 faculty member by an institution's award of tenure can be at any time
2525 revoked, limited, altered or otherwise modified by the awarding institution
2626 or by the state board of regents.
2727 (e) Nothing in this section shall be interpreted or used to infringe or
2828 abrogate a faculty member's otherwise constitutionally protected rights or
2929 interests.
3030 (f) As used in this section:
3131 (1) "Faculty" means any unclassified employee of any institution
3232 whose primary duties include teaching or research, regardless of rank or
3333 title, except employees who are employed under an employment contract;
3434 (2) "institution" means any postsecondary educational institution as
3535 defined in K.S.A. 74-3201b, and amendments thereto;
3636 (3) "state board of regents" means the same as defined in K.S.A. 76-
3737 711, and amendments thereto; and
3838 (4 ) "tenure" means a feature of employment that:
3939 (A) Shall be affirmatively granted by an institution at its discretion in

7575 recognition of meritorious performance and thereafter conditioned on
7676 future meritorious performance; and
7777 (B) may conditionally confer special benefits, processes or
7878 preferences.
7979 Sec. 2. This act shall take effect and be in force from and after its
