| 5 | 5 | | AN ACT concerning public assistance; requiring approval by an act of the |

| 6 | 6 | | legislature prior to any state agency seeking or implementing any |
|---|
| 7 | 7 | | public assistance program waiver or other authorization from the |
|---|
| 8 | 8 | | federal government that expands eligibility for any public assistance |
|---|
| 9 | 9 | | program or increases cost to the state. |
|---|
| 10 | 10 | | Be it enacted by the Legislature of the State of Kansas: |
|---|
| 11 | 11 | | Section 1. (a) On and after July 1, 2025, no state agency shall seek or |
|---|
| 12 | 12 | | implement any public assistance program waiver or other authorization |
|---|
| 13 | 13 | | from the federal government, including, but not limited to, a medicaid |
|---|
| 14 | 14 | | state plan, state plan amendment, state demonstration or a waiver pursuant |
|---|
| 15 | 15 | | to section 1115 or 1915 of the federal social security act, that would |
|---|
| 16 | 16 | | expand eligibility for any public assistance program to any additional |
|---|
| 17 | 17 | | individuals or class of individuals or would increase any cost to the state |
|---|
| 18 | 18 | | unless the legislature expressly consents to, and approves of, such waiver |
|---|
| 19 | 19 | | or other authorization by an act of the legislature. The provisions of this |
|---|
| 20 | 20 | | paragraph shall not affect any state plan amendment or waiver program |
|---|
| 21 | 21 | | already being implemented prior to July 1, 2025. |
|---|
| 22 | 22 | | (b) For purposes of this section: |
|---|
| 23 | 23 | | (1) "Public assistance program" means any assistance under K.S.A. |
|---|
| 24 | 24 | | 39-709, and amendments thereto; and |
|---|
| 25 | 25 | | (2) "state agency" means the same as defined in K.S.A. 75-3701, and |
|---|
| 26 | 26 | | amendments thereto. |
|---|
| 27 | 27 | | Sec. 2. This act shall take effect and be in force from and after its |
|---|
| 28 | 28 | | publication in the statute book. |
