55 AN ACT concerning public assistance; requiring approval by an act of the
66 legislature prior to any state agency seeking or implementing any
77 public assistance program waiver or other authorization from the
88 federal government that expands eligibility for any public assistance
99 program or increases cost to the state.
1010 Be it enacted by the Legislature of the State of Kansas:
1111 Section 1. (a) On and after July 1, 2025, no state agency shall seek or
1212 implement any public assistance program waiver or other authorization
1313 from the federal government, including, but not limited to, a medicaid
1414 state plan, state plan amendment, state demonstration or a waiver pursuant
1515 to section 1115 or 1915 of the federal social security act, that would
1616 expand eligibility for any public assistance program to any additional
1717 individuals or class of individuals or would increase any cost to the state
1818 unless the legislature expressly consents to, and approves of, such waiver
1919 or other authorization by an act of the legislature. The provisions of this
2020 paragraph shall not affect any state plan amendment or waiver program
2121 already being implemented prior to July 1, 2025.
2222 (b) For purposes of this section:
2323 (1) "Public assistance program" means any assistance under K.S.A.
2424 39-709, and amendments thereto; and
2525 (2) "state agency" means the same as defined in K.S.A. 75-3701, and
2626 amendments thereto.
2727 Sec. 2. This act shall take effect and be in force from and after its
2828 publication in the statute book.
