AN ACT relating to postpartum Medicaid coverage. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. KRS 205.592 is amended to read as follows: 3
[Beginning October 1, 1990, ]Pregnant women, new mothers up to twelve (12) months 4
postpartum, and children up to age one (1) shall be eligible for participation in the 5
Kentucky Medical Assistance Program if: 6
(1) They have family income up to but not exceeding one hundred and eighty-five 7
percent (185%) of the nonfarm income official poverty guidelines as promulgated 8
by the Department of Health and Human Services of the United States as revised 9
annually; and 10
(2) They are otherwise eligible for the program. 11
Section 2. If the Cabinet for Health and Family Services or the Department for 12
Medicaid Services determines that a waiver or any other authorization from a federal 13
agency is necessary prior to the implementation of Section 1 of this Act, the cabinet or 14
department shall, within 90 days after the effective date of this Act, request the waiver or 15
authorization and shall only delay full implementation of Section 1 of this Act until the 16
waiver or authorization is granted. 17
