AN ACT relating to limited X-ray machine operators. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 311B.020 is amended to read as follows: 3 
As used in this chapter, unless the context clearly requires otherwise: 4 
(1) "Accredited educational program" means a program that is approved by a national 5 
organization acceptable to the board to provide education in medical imaging or 6 
radiation therapy; 7 
(2) "Actively employed" means an individual who is appropriately credentialed and 8 
currently employed as an advanced imaging professional, medical imaging 9 
technologist, radiation therapist, an educator or administrator in any of these 10 
disciplines, or a limited X-ray machine operator; 11 
(3) "Advanced imaging professional" means an individual who is credentialed by a 12 
nationally recognized certification organization that is recognized by the board; 13 
(4) "Authorized user" means a physician, dentist, or podiatrist identified on a 14 
radioactive materials license that authorizes the medical use of radioactive materials 15 
if the license was issued by: 16 
(a) The Cabinet for Health and Family Services; 17 
(b) The United States Nuclear Regulatory Commission; or 18 
(c) Another United States Nuclear Regulatory Commission agreement state; 19 
(5) "Board" means the Kentucky Board of Medical Imaging and Radiation Therapy; 20 
(6) "Credentialed" means someone who is certified and registered by an appropriate 21 
national organization that is recognized by the board; 22 
(7) "Continuing education" means a learning activity that is planned, organized, and 23 
administered to enhance the professional knowledge and skills of a licensed 24 
individual of medical imaging or radiation therapy to provide services for patients, 25 
the public, or the medical profession; 26 
(8) "Licensed practitioner" or "licensed practitioner of the healing arts" means a person 27  UNOFFICIAL COPY  	22 RS HB 61/GA

licensed in Kentucky to practice medicine, osteopathy, dentistry, chiropractic, 1 
podiatry, or veterinary medicine; 2 
(9) (a)    "Limited X-ray machine operator" means an individual who performs 3 
limited radiographic procedures in facilities where contrast studies, 4 
fluoroscopy[fluoroscopic], nuclear medicine, or radiation therapy procedures 5 
are not performed.[;]  6 
 (b)    Notwithstanding paragraph (a) of this subsection, an individual who 7 
holds a limited X-ray machine operator license may continue to be 8 
employed as a limited X-ray machine operator by a facility in which 9 
contrast studies, fluoroscopy, nuclear medicine, or radiation therapy 10 
procedures are performed if he or she was employed in that capacity by that 11 
facility: 12 
 1.     Prior to the facility performing contrast studies, fluoroscopy, nuclear 13 
medicine, or radiation therapy procedures; or 14 
2.     Prior to the effective date of this Act. 15 
(10) "Medical imaging technologist" means an individual who has completed an 16 
accredited educational program in radiography, nuclear medicine, or other imaging 17 
modality recognized by the board and who is licensed and granted privileges under 18 
this chapter. Other than a limited X-ray machine operator who meets the 19 
qualifications of subsection (9) (b) 1. or 2. of this section, only an individual 20 
licensed as a medical imaging technologist shall be employed to perform medical 21 
imaging at a facility where contrast studies, fluoroscopy[fluoroscopic], nuclear 22 
medicine, or radiation therapy procedures are performed; 23 
(11) "National organization" means: 24 
(a) The American Society of Radiologic Technologists; 25 
(b) The Nuclear Medicine Technology Certification Board; 26

(d) The Society of Nuclear Medicine Technologist Section; 1 
(e) The Joint Review Committee on Education in Radiologic Technology; 2 
(f) The Joint Review Committee on Educational Programs in Nuclear Medicine 3 
Technology; 4 
(g) The American College of Radiology; or 5 
(h) Another national organization recognized by the board; 6 
(12) "Nuclear medicine technologist" means an individual who is authorized to prepare 7 
and administer radiopharmaceuticals, pharmaceuticals, and radionuclides under the 8 
direction of an authorized user to perform nuclear medicine procedures for 9 
diagnostic and therapeutic purposes; 10 
(13) "Post-primary certification" means an individual who has primary certification and 11 
has been awarded post-primary certification by a national organization that has been 12 
recognized by the board; 13 
(14) "Primary certification" means an individual who has successfully completed a 14 
formal educational program and certification in radiography, nuclear medicine, 15 
radiation therapy, or other modality recognized by the board; 16 
(15) "Radiation therapist" means an individual who: 17 
(a) Has completed an accredited educational program in radiation therapy; 18 
(b) Is licensed by the board; and 19 
(c) Is authorized to utilize ionizing radiation-generating equipment and sources of 20 
radiation for the planning, localization, and delivery of therapeutic procedures 21 
on human beings; and 22 
(16) "Radiographer" means an individual who is authorized to use ionizing radiation-23 
generating equipment to perform a comprehensive scope of diagnostic imaging 24 
procedures and is responsible for the operation of radiation-generating equipment, 25 
protecting the patient and staff from unnecessary radiation, and selecting the 26 
appropriate exposure to produce diagnostic images with the lowest reasonable 27  UNOFFICIAL COPY  	22 RS HB 61/GA
