UNOFFICIAL COPY 22 RS HB 755/GA Page 1 of 2 HB075510.100 - 2121 - XXXX GA AN ACT establishing the Ratepayer Protection Task Force. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 Section 1. The Legislative Research Commission shall establish the Ratepayer 3 Protection Task Force to: 4 (1) Examine the calculation and use of the fuel adjustment clause by electric 5 utilities regulated by the Public Service Commission and provide recommendations for 6 how to reduce the volatility of fuel adjustment clause charges on electric utility bills; 7 (2) Investigate the feasibility of establishing a process to allow utilities regulated 8 by the Public Service Commission to securitize deferred expenses held as regulatory 9 assets in order to produce lower rates than if they were amortized through a utility’s rates 10 using conventional ratemaking; and 11 (3) Study the impact on utility customers of the premature retirement of electric 12 generating facilities owned by electric utilities regulated by the Public Service 13 Commission and explore options for keeping electric generating facilities in service for 14 the entirety of their useful lives, including requiring electric utilities to attempt to sell 15 electric generating units prior to declaring them retired. 16 Section 2. The Ratepayer Protection Task Force shall have the following 17 members, with final membership of the task force being subject to the consideration and 18 approval of the Legislative Research Commission: 19 (1) Four members of the House of Representatives chosen by the Speaker of the 20 House of Representatives, one of whom shall be designated as co-chair; 21 (2) Two members of the House of Representatives chosen by the House Minority 22 Floor Leader; 23 (3) Four members of the Senate chosen by the President of the Senate, one of 24 whom shall be designated co-chair; and 25 (4) Two members of the Senate chosen by the Senate Minority Floor Leader. 26 Section 3. The task force shall meet at least three times during the 2022 Interim 27 UNOFFICIAL COPY 22 RS HB 755/GA Page 2 of 2 HB075510.100 - 2121 - XXXX GA and shall submit its findings, legislative recommendations, or a memorandum to the 1 Legislative Research Commission no later than December 1, 2022. If legislative 2 recommendations are submitted, the Legislative Research Commission may refer the 3 recommendations to the appropriate committee or committees of jurisdiction in advance 4 of the 2023 Regular Session of the Kentucky General Assembly. 5 Section 4. Provisions of this Act to the contrary notwithstanding, the Legislative 6 Research Commission shall have the authority to alternatively assign the issues identified 7 herein to an interim joint committee or subcommittee thereof and to designate a study 8 completion date. 9
