UNOFFICIAL COPY 24 RS BR 235 Page 1 of 1 XXXX 1/5/2024 8:53 AM Jacketed AN ACT relating to sudden unexpected death in epilepsy. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 SECTION 1. A NEW SECTION OF KRS CHAPTER 211 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) For the purposes of this section, "SUDEP" means sudden unexpected death in 5 epilepsy. 6 (2) A physician or health care provider who has diagnosed and established a 7 treatment plan for a patient with convulsive epilepsy is encouraged to provide the 8 patient with information about SUDEP, including but not limited to risk, 9 incidence, and steps to reduce the risk of SUDEP. 10 SECTION 2. A NEW SECTION OF KRS CHAPTER 72 IS CREATED TO 11 READ AS FOLLOWS: 12 (1) For the purposes of this section, "SUDEP" means sudden unexpected death in 13 epilepsy. 14 (2) All autopsies conducted in this state as required by KRS 72.025 shall include, if 15 requested by an immediate family member of the deceased, an inquiry to 16 determine whether the death is a direct result of a seizure or epilepsy. If the 17 finding in an autopsy is consistent with SUDEP, the coroner shall: 18 (a) Indicate on the death certificate that SUDEP is the cause or suspected 19 cause of death; and 20 (b) Forward a copy of the death certificate to the North American SUDEP 21 Registry at the Langone Medical Center at New York University within 22 thirty (30) days. 23 Section 3. This Act may be cited as Jami's Law. 24
