AN ACT amending the 2022-2024 State/Executive Branch biennial budget, making 1
an appropriation therefor, and declaring an emergency. 2
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3
Section 1. 2022 Kentucky Acts Chapter 199, Part I, Operating Budget, A. 4
General Government, 6. Military Affairs, (2) Disaster or Emergency Aid Funds, at page 5
1637, is amended to read as follows: 6
(2) Disaster or Emergency Aid Funds: There is appropriated from the General 7
Fund up to $50,000,000 in fiscal year 2023-2024[the necessary funds], subject to the 8
conditions and procedures in this Act, which are the funds required to match federal aid 9
for which the state would be eligible in the event of a presidentially declared disaster or 10
emergency. These necessary funds shall be made available from the General Fund 11
Surplus Account (KRS 48.700) or the Budget Reserve Trust Fund Account (KRS 12
48.705). 13
Section 2. 2022 Kentucky Acts Chapter 199, Part I, Operating Budget, H. 14
Justice and Public Safety Cabinet, 5. Corrections, b. Adult Correctional Institutions, (3) 15
Operational Costs for Inmate Population, at page 1686, is amended to read as follows: 16
(3) Operational Costs for Inmate Population: In the event that actual 17
operational costs exceed the amounts appropriated to support the budgeted average daily 18
population of state felons for each fiscal year, up to $1,000,000 in fiscal year 2023-19
2024[the additional payments] shall be deemed necessary government expenses and shall 20
be paid from the General Fund Surplus Account (KRS 48.700) or the Budget Reserve 21
Trust Fund Account (KRS 48.705), subject to notification as to necessity and amount by 22
the State Budget Director who shall report any certified expenditure to the Interim Joint 23
Committee on Appropriations and Revenue. 24
Section 3. Whereas the provisions of this Act provide ongoing support for 25
programs funded in the 2022-2024 State/Executive Branch biennial budget, an 26
emergency is declared to exist, and this Act takes effect upon its passage and approval by 27 UNOFFICIAL COPY 24 RS BR 1025
