UNOFFICIAL COPY 24 RS SB 3/GA Page 1 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA AN ACT relating to the Department of Agriculture and declaring an emergency. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 Section 1. KRS 150.021 is amended to read as follows: 3 (1) The Department of Fish and Wildlife Resources shall constitute an independent 4 department of state government within the meaning of KRS Chapter 12, and shall 5 be administratively attached to the Department of Agriculture[Tourism, Arts and 6 Heritage Cabinet] only for those limited functions and purposes expressly requested 7 by the department to be performed by the Department of Agriculture[Tourism, 8 Arts and Heritage Cabinet]. The department shall have sole discretion as to which 9 functions shall be deemed necessary for the efficient operation of the department 10 and the properties in its custody and control. The department shall consist of a 11 commissioner, a Fish and Wildlife Resources Commission, the Division of Law 12 Enforcement, and other agents and employees provided for in this chapter. The 13 department shall enforce the laws and regulations adopted under this chapter 14 relating to wildlife and shall exercise all powers necessarily incident thereto. 15 (2) (a) The Finance and Administration Cabinet shall assess the Department of Fish 16 and Wildlife Resources each fiscal year a fee in an amount equal to five 17 percent (5%) of the debt service associated with all phases and 18 implementation of the capital project to replace, repair, or maintain the two 19 (2) way radio system utilized by the Department of Kentucky State Police. 20 (b) The fee shall be assessed on each phase of the implementation of the two (2) 21 way radio system and shall continue to be assessed until all debt for the 22 system has been retired. 23 (3) On the effective date of this Act[April 13, 2022], copies of any records, files, or 24 documents, including any legal documents or memoranda, associated with 25 functions of the Department of Fish and Wildlife Resources[ that were previously] 26 performed by the Tourism, Arts and Heritage Cabinet[ but for which it is no longer 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 2 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA deemed responsible,] shall be transmitted to the department. 1 (4) The department shall not be subject to reorganization under KRS Chapter 12. 2 Section 2. KRS 150.022 is amended to read as follows: 3 (1) The Department of Fish and Wildlife Resources Commission shall consist of nine 4 (9) members, one (1) from each commission district, as set out by the commissioner 5 with the approval of the commission, and not more than five (5) of the same 6 political party. 7 (2) The Commissioner of Agriculture[Governor] shall appoint the members of the 8 commission subject to confirmation by the Senate as described in subsection (3) of 9 this section. Each of the members shall be appointed for a term ending on 10 December 31 of the fourth calendar year following his or her appointment, except 11 that a member's term shall continue until his or her successor is duly appointed and 12 confirmed by the Senate, but no later than one (1) year following the expiration of 13 the member's term. If after one (1) year a successor has not been duly appointed and 14 confirmed by the Senate, the commissioner's seat for that district shall be vacant 15 until a successor is duly appointed and confirmed by the Senate. A member shall 16 serve no more than two (2) full terms, not including any partial term that a member 17 may additionally serve. A person who has been convicted of a felony offense, in 18 Kentucky or under the law of any other state, or any other law of the United States 19 shall not be eligible to serve on the commission. 20 (3) (a) Vacancies through the expiration of terms of the members of the commission 21 shall be filled by appointment by the Commissioner of 22 Agriculture[Governor] from a list of five (5) names from each commission 23 district, recommended and submitted by the sportsmen of each respective 24 district. 25 (b) When the term of a member expires, the commissioner shall call a meeting of 26 the sportsmen in that district not later than thirty (30) days prior to the 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 3 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA expiration of the member's term. Notice of the meeting shall be given by 1 publication pursuant to KRS Chapter 424. 2 (c) At the meeting, the sportsmen in attendance shall select and submit to the 3 Commissioner of Agriculture[Governor] a list of five (5) residents and 4 citizens of the district who have held hunting and fishing licenses in Kentucky 5 or another state for at least the previous five (5) consecutive years, or who 6 have been hunting and fishing in the Commonwealth for the previous five (5) 7 consecutive years while license-exempt under KRS 150.170, and who are well 8 informed on the subject of wildlife conservation and restoration. Each 9 sportsman may vote for one (1) candidate only, and the list submitted to the 10 Commissioner of Agriculture[Governor] shall be made up of the names of 11 the five (5) candidates receiving the five (5) highest vote totals. 12 (d) The Commissioner of Agriculture[Governor] shall appoint a successor to the 13 member whose term has expired no later than January 20 of the year 14 following the year in which the member's term expired. 15 (4) Upon appointment to the Department of Fish and Wildlife Resources Commission, 16 each commissioner shall execute a bond of one thousand dollars ($1,000) in favor 17 of the Department of Fish and Wildlife Resources, the premium on this bond to be 18 paid out of department funds. 19 (5) In the event of vacancies other than by expiration, the Commissioner of 20 Agriculture[Governor] shall fill the vacancy for the unexpired part of the term from 21 the names remaining on the list previously submitted for the district from which the 22 vacancy arose. An appointee chosen under this subsection shall not serve on the 23 commission until duly confirmed by the Senate. 24 (6) Each member of the commission shall take the constitutional oath of office. 25 (7) The Commissioner of Agriculture[Governor] shall remove any member of the 26 commission for cause under subsection (2) of this section and may remove a 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 4 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA member of the commission for nonfeasance, neglect of duty, or misconduct in 1 office; but shall first deliver to the member a copy of all charges in writing and 2 afford to him or her an opportunity for an administrative hearing to be conducted in 3 accordance with KRS Chapter 13B. 4 (8) Each member of the commission shall be entitled to reimbursement for actual and 5 necessary traveling and other expenses incurred by him or her in the discharge of 6 his or her official duties and to be paid from the game and fish fund. 7 (9) A majority of the commission shall constitute a quorum for the transaction of any 8 business, for the performance of any duty or for the exercise of any power vested in 9 the commission. 10 (10) The department shall have its principal office in Franklin County, and is authorized 11 to purchase all supplies, equipment, and printed forms and to issue any notices and 12 publications as the commissioner may deem necessary to carry out the provisions of 13 this chapter. 14 (11) The word "sportsman" as used in this section shall mean a resident hunter or 15 fisherman who has been licensed in Kentucky for each of the past two (2) 16 consecutive years. 17 Section 3. KRS 150.061 is amended to read as follows: 18 (1) Notwithstanding any provisions of KRS Chapter 18A, 42, 45, 45A, 56, or 64 to the 19 contrary, the commission shall have the sole authority to appoint a commissioner of 20 the Department of Fish and Wildlife Resources, who shall be a person with 21 knowledge of and experience in the requirements for the protection, conservation 22 and restoration of the wildlife resources of the state. The commission shall be the 23 sole contracting body for the purposes of KRS Chapter 45A and shall submit any 24 proposed personal service contract with a commissioner to the Government Contact 25 Review Committee for its review pursuant to KRS 45A.690 to 45A.725. The 26 commissioner shall serve for a defined employment contract term not to exceed 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 5 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA four (4) years and shall be subject to: 1 (a) Annual review by the commission in closed, executive session; 2 (b) Removal by the commission for the same cause and in the same manner in 3 which the Commissioner of Agriculture[Governor] may remove a member of 4 the commission; and 5 (c) Reappointment by the commission. 6 (2) The commissioner shall receive such compensation as the commission may solely 7 determine, and shall be reimbursed for all actual and necessary travel and other 8 expenses incurred by him or her in the performance of his or her official duties. 9 (3) Before entering upon the duties of his or her office, the commissioner shall take and 10 subscribe to the constitutional oath of office, and shall, in addition thereto, swear or 11 affirm that he or she holds no other public office, nor any position upon or under 12 any political committee or party. Upon appointment by the commission, the 13 commissioner shall execute a bond of five thousand dollars ($5,000) in favor of the 14 Department of Fish and Wildlife Resources, the premium on said bond to be paid 15 out of department funds. 16 (4) Notwithstanding any provision of law to the contrary, the commissioner shall be the 17 sole appointing authority for the department for the purposes of KRS Chapter 18A 18 and shall have general supervision and control of all activities, functions, 19 appointments, and employees of the department. He or she shall enforce all 20 provisions of the laws of the state relating to wild animals, birds, fish and 21 amphibians, and shall exercise all powers necessarily incident thereto not 22 specifically conferred on the commission. The commissioner shall make an annual 23 report of all receipts and disbursements and file same with the Secretary of State of 24 the Commonwealth of Kentucky. 25 (5) If federal or other grant funds become available to pay their salaries, the 26 commissioner may appoint and employ other persons that he or she may deem 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 6 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA necessary or desirable to accomplish the purposes of this chapter. The 1 commissioner shall determine the compensation, duties, and terms of employment 2 of these employees, and grant funded, time-limited positions shall be approved by 3 the commission as needed. Employees whose salaries are funded through federal or 4 other grant funds shall not be counted in any tally of permanent employees made 5 for employee cap or budgetary purposes. 6 Section 4. KRS 235.010 is amended to read as follows: 7 As used in this chapter, unless the context clearly requires a different meaning: 8 (1) "Vessel" means every description of watercraft, other than a seaplane on the water; 9 (2) "Motorboat" means any vessel propelled by machinery, whether or not such 10 machinery is the principal source of propulsion, except for the following: 11 (a) Boats or vessels propelled totally by a direct current battery-powered motor 12 when used on private waters; 13 (b) Boats propelled by human power employing the use of hand or foot operation; 14 and 15 (c) Federally regulated commercial vessels; 16 (3) "Owner" means a person, other than a lienholder, having the property in or title to a 17 motorboat. The term includes a person entitled to the use or possession of a 18 motorboat subject to an interest in another person, reserved or created by agreement 19 and securing payment or performance of an obligation, but the term excludes a 20 lessee under a lease not intended as security; 21 (4) "Personal watercraft" means a vessel which uses an internal combustion engine to 22 power a jet pump for its primary source of propulsion and is designed to be 23 operated by a person sitting, standing, or kneeling on the vessel rather than to be 24 operated by a person sitting or standing inside the vessel; 25 (5) "Safe boating certificate" means a document attesting the successful completion of 26 instruction, approved by the department or given by the United States Coast Guard 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 7 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA or Coast Guard Auxiliary or the United States Power Squadron, to prepare an 1 individual to safely operate a motorboat or personal watercraft on the waters of the 2 Commonwealth; 3 (6) "Waters of this state" means any waters within the territorial limits of this state; 4 (7) "Person" means an individual, partnership, firm, corporation, association, or other 5 entity; 6 (8) "Operate" means to navigate or otherwise use a motorboat or a vessel; 7 (9) ["Cabinet" means the Tourism, Arts and Heritage Cabinet; 8 (10) ]"Department" means the Department of Fish and Wildlife Resources; 9 (10)[(11)] "License" and "certificate of number" as used herein are synonymous; 10 (11)[(12)] "Clerk" means county clerk; 11 (12)[(13)] "Division of Law Enforcement" means the Division of Law Enforcement, 12 Department of Fish and Wildlife Resources administratively attached to the 13 Department of Agriculture[Tourism, Arts and Heritage Cabinet]; 14 (13)[(14)] "Title" means the certificate of title; 15 (14)[(15)] "Commissioner" means the commissioner of the Department of Fish and 16 Wildlife Resources; 17 (15)[(16)] "Federally regulated commercial vessel" means any vessel holding a United 18 States certificate of documentation with a coastwise trade endorsement; 19 (16)[(17)] "Marina" means a dock or basin providing moorings for motorboats and 20 offering supply, repair, or other services for remuneration; and 21 (17)[(18)] "Marine sanitation device" means equipment that is identified by the United 22 States Coast Guard as meeting the standards of the United States Environmental 23 Protection Agency or that is approved by the Energy and Environment Cabinet, to 24 eliminate the discharge of untreated sewage from vessels into the waters of the 25 Commonwealth and is a device that receives, treats, retains, or discharges sewage. 26 Section 5. KRS 235.030 is amended to read as follows: 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 8 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA This chapter shall be known as the State Boating Act and shall be administered by the 1 Department of Fish and Wildlife Resources, which is administratively attached to the 2 Department of Agriculture[Tourism, Arts and Heritage Cabinet] only for those limited 3 functions and purposes expressly requested by the department to be performed by the 4 Department of Agriculture[Tourism, Arts and Heritage Cabinet]. The department shall 5 have sole discretion as to which functions shall be deemed necessary for the efficient 6 operation of the department and the properties in its custody and control. The 7 Transportation Cabinet shall be responsible for administering the boat numbering, 8 registration, and titling requirements. 9 Section 6. KRS 235.130 is amended to read as follows: 10 (1) No person acting for himself or another shall buy or trade for any motorboat 11 without receiving the certificate of title issued for that boat with a certificate of 12 transfer endorsed thereon. If the motorboat has not been issued a certificate of title 13 as noted on the certificate of registration, the person shall receive a completed 14 assignment of title on a boat transaction record and the certificate of registration. 15 (2) It shall be the duty of the purchaser to promptly submit the endorsed certificate of 16 title or boat transaction record and certificate of registration to the county clerk of 17 the county of the purchaser's residence or in which the motorboat is to be 18 principally operated. The purchaser shall apply for a new certificate of title and 19 registration pursuant to KRS 235.050. The county clerk shall thereupon issue to the 20 purchaser a transfer of registration bearing the same data and information. The clerk 21 shall forward the endorsed certificate of title or boat transaction record and 22 certificate of registration and new application for title and registration to the 23 Transportation Cabinet. Except when registration is prohibited by law, any 24 unexpired registration shall remain valid after transfer until expiration occurs 25 according to law. 26 (3) For transferring the registration, the clerk shall collect a fee of five dollars ($5). The 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 9 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA clerk shall retain two dollars ($2), the Transportation Cabinet shall receive two 1 dollars ($2) and the Department of Fish and Wildlife Resources administratively 2 attached to the Department of Agriculture[Tourism, Arts and Heritage Cabinet] 3 shall receive one dollar ($1). The fee received by the Transportation Cabinet shall 4 be deposited in a trust and agency account for use by the Transportation Cabinet in 5 defraying the cost of implementing and operating the boat titling and registration 6 program. The fee for transferring the title shall be as required by KRS 235.085. 7 (4) If a transferee does not promptly submit the necessary documents to the county 8 clerk as required by law in order to complete the transfer transaction, a transferor 9 may submit to the county clerk, after the passage of fifteen (15) calendar days, in 10 his or her county of residence, an affidavit that he or she has transferred his or her 11 interest in a specific motorboat and the clerk may enter appropriate data into the 12 AVIS system which would restrict any registration transaction from occurring on 13 that vehicle until the transfer was processed. 14 (5) If the owner junks or otherwise renders a motorboat unfit for future use, he or she 15 shall deliver the title to the county clerk of the county in which the motorboat is 16 junked. The county clerk shall immediately return the title to the Transportation 17 Cabinet. The owner shall pay to the county clerk fifty cents ($0.50) for his or her 18 services. 19 Section 7. KRS 230.225 is amended to read as follows: 20 (1) The Kentucky Horse Racing Commission shall constitute[is created as] an 21 independent department[agency] of state government to regulate the conduct of 22 horse racing and pari-mutuel wagering on horse racing, sports wagering, and related 23 activities within the Commonwealth of Kentucky. The racing commission shall be 24 administratively attached to the Department of Agriculture only for those limited 25 functions and purposes expressly requested by the racing commission to be 26 performed by the Department of Agriculture. The racing commission shall have 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 10 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA sole discretion as to which functions shall be deemed necessary for the efficient 1 operation of the racing commission and the properties in its custody and control 2 [Public Protection Cabinet for administrative purposes]. 3 (2) (a) 1. The Kentucky Horse Racing Commission shall consist of fifteen (15) 4 members appointed by the Governor, with the secretaries of the [Public 5 Protection Cabinet, ]Tourism, Arts and Heritage Cabinet, and Cabinet 6 for Economic Development[ Cabinet], and the Commissioner of 7 Agriculture, or their designees, serving as ex officio nonvoting 8 members. 9 2. The members appointed by the Governor shall be subject to Senate 10 confirmation in accordance with KRS 11.160. 11 (b) Two (2) members shall have no financial interest in the business or industry 12 regulated. 13 (c) The members of the racing commission shall be appointed to serve for a term 14 of four (4) years, except the initial terms shall be staggered as follows: 15 1. Five (5) members shall serve for a term of four (4) years; 16 2. Five (5) members shall serve for a term of three (3) years; and 17 3. Five (5) members shall serve for a term of two (2) years. 18 (d) 1. a. Members of the racing commission shall serve until their 19 successors are duly appointed and confirmed by the Senate, but 20 no later than one (1) year following the expiration of the 21 member's term. 22 b. If after one (1) year a successor has not been duly appointed and 23 confirmed by the Senate, that seat shall become vacant and 24 remain vacant until a successor has been duly appointed and 25 confirmed. 26 2. Any member appointed to fill a vacancy occurring other than by 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 11 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA expiration of a term shall be appointed for the remainder of the 1 unexpired term. A member chosen under this subparagraph shall not 2 serve on the racing commission until duly confirmed by the Senate. 3 (e) In making appointments, the Governor may consider members broadly 4 representative of the Thoroughbred industry and members broadly 5 representative of the standardbred, quarter horse, Appaloosa, or Arabian 6 industries. The Governor may also consider recommendations from the 7 Kentucky Thoroughbred Owners and Breeders, Inc., the Kentucky Division of 8 the Horsemen's Benevolent and Protective Association, the Kentucky Harness 9 Horsemen's Association, and other interested organizations. 10 (3) (a) Members of the racing commission shall receive no compensation for serving 11 on the commission, but shall be reimbursed for travel expenses for attending 12 meetings and performing other official functions consistent with the 13 reimbursement policy for state employees established by KRS 45.101 and 14 administrative regulations promulgated thereunder. 15 (b) The Governor shall appoint one (1) member of the racing commission to serve 16 as its chairperson who shall serve at the pleasure of the Governor. 17 (c) The Governor shall further designate a second member to serve as vice chair 18 with authority to act in the absence of the chairperson. 19 (d) Before entering upon the discharge of their duties, all members of the 20 Kentucky Horse Racing Commission shall take the constitutional oath of 21 office. 22 (4) (a) The racing commission shall establish and maintain a general office for the 23 transaction of its business and may in its discretion establish a branch office 24 or offices. 25 (b) The racing commission may hold meetings at any of its offices or at any other 26 place when the convenience of the racing commission requires. 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 12 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA (c) All meetings of the racing commission shall be open and public, and all 1 persons shall be permitted to attend meetings. 2 (d) A majority of the voting members of the racing commission shall constitute a 3 quorum for the transaction of its business or exercise of any of its powers. 4 (5) Except as otherwise provided, the racing commission shall be responsible for the 5 following: 6 (a) Developing and implementing programs designed to ensure the safety and 7 well-being of horses, jockeys, and drivers; 8 (b) Developing programs and procedures that will aggressively fulfill its 9 oversight and regulatory role on such matters as medical practices and 10 integrity issues; 11 (c) Recommending tax incentives and implementing incentive programs to ensure 12 the strength and growth of the equine industry; 13 (d) Designing and implementing programs that strengthen the ties between 14 Kentucky's horse industry and the state's universities, with the goal of 15 significantly increasing the economic impact of the horse industry on 16 Kentucky's economy, improving research for the purpose of promoting the 17 enhanced health and welfare of the horse, and other related industry issues; 18 (e) Developing and supporting programs which ensure that Kentucky remains in 19 the forefront of equine research; 20 (f) Developing monitoring programs to ensure the highest integrity of sporting 21 events and sports wagering; and 22 (g) Developing a program to share wagering information with sports governing 23 bodies upon which sports wagering may be conducted. The program shall be 24 designed to assist the racing commission in determining potential problems or 25 questionable activity and provide reports to sports governing bodies 26 effectively. 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 13 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA Section 8. KRS 230.817 is amended to read as follows: 1 (1) (a) There is hereby established in the State Treasury a restricted account to be 2 known as the sports wagering administration fund. The fund shall consist of 3 moneys received from the moneys collected under KRS 138.552, 230.811, 4 and 230.814 and state appropriations. 5 (b) 1. The amounts deposited in the fund shall be used as follows: 6 a. For administrative expenses relating to or associated with the 7 purposes of sports wagering which shall be disbursed by the 8 Finance and Administration Cabinet upon the warrant of the 9 Commissioner of Agriculture[Public Protection Cabinet]; and 10 b. Two and one-half percent (2.5%) of the funds shall be deposited in 11 the Kentucky problem gambling assistance account established in 12 KRS 230.826. 13 2. The remaining funds shall be deposited in the Kentucky permanent 14 pension fund established in KRS 42.205. 15 3. Any interest accruing to the fund shall become a part of the fund and 16 shall not lapse. 17 (2) Notwithstanding KRS 45.229, fund amounts not expended at the close of a fiscal 18 year shall not lapse but shall be carried forward into the next fiscal year. 19 (3) Moneys deposited in the fund are hereby appropriated for the purposes set forth in 20 this section and shall not be appropriated or transferred by the General Assembly 21 for any other purposes. 22 Section 9. KRS 12.252 is amended to read as follows: 23 (1) There is established within the Public Protection Cabinet a Department of Financial 24 Institutions, a Department of Insurance, a Department of Housing, Buildings and 25 Construction, a Department of Charitable Gaming, a Department of Professional 26 Licensing, and a Department of Alcoholic Beverage Control. Each department shall 27 UNOFFICIAL COPY 24 RS SB 3/GA Page 14 of 63 SB000310.100 - 1346 - XXXX 3/15/2024 1:08 PM GA be headed by a commissioner appointed by the Governor as required by KRS 1 12.040 and, where appropriate, by KRS 238.510, 241.015, and 304.2-020. 2 Commissioners shall be directly responsible to the secretary and shall perform the 3 functions, powers, and duties provided by law and prescribed by the secretary. 4 (2) The secretary of the Public Protection Cabinet shall be appointed by the Governor 5 in accordance with KRS 12.255. The appointments made by executive orders under KRS 150.022 2 before the effective date of this Act, of commissioners to represent the Second, Third, 3 Seventh, Eighth, and Ninth Commission Districts shall expire and be vacated as of the 4 effective date of this Act. The lists of candidates for appointment generated as a result of 5 district meetings held in the Second, Third, Seventh, Eighth, and Ninth Commission 6 Districts shall be delivered to the Commissioner of Agriculture on the effective date of 7 this Act. The Commissioner of Agriculture shall make appointments by executive order 8 and deliver a copy of the executive order and all information required by KRS 11.160 to 9 the Clerk of the Senate within 10 days of the receipt of the lists. Notwithstanding any 10 other law to the contrary, the commissioners appointed by the Commissioner of 11 Agriculture pursuant to Section 2 of this Act shall take their seats upon appointment. 12 Section 15. Whereas the orderly administration of the Department of Fish and 13 Wildlife Resources and the Kentucky Horse Racing Commission and the interests of 14 Kentuckians who enjoy activities supported by the department and commission deserve 15 to be free from executive branch decisions based on considerations other than the best 16 interests of those agencies and the Kentuckians they serve, an emergency is declared to 17 exist, and this Act takes effect upon its passage and approval by the Governor or upon its 18 otherwise becoming a law. 19
