FUNDS/FUNDING: Requires fifty percent of nonrecurring revenues be allocated to the
highway priority program
AN ACT1
To amend and reenact R.S. 39:34(B)(1) and 54(B)(1), relative to budgetary controls; to2
require a percentage of nonrecurring revenue be appropriated for highway3
construction according to the priority of projects determined by the Department of4
Transportation and Development; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 39:34(B)(1) and 54(B)(1) are hereby amended and reenacted to read7
as follows: 8
§34.  Executive budget9

B. The executive budget recommendations for appropriations of any money11
designated in the official forecast as nonrecurring shall be made only in accordance12
with the following:13
(1)(a) At a minimum, twenty-five percent of nonrecurring revenue shall be14
reserved for appropriation to the Budget Stabilization Fund. The governor may also15
recommend reserving nonrecurring revenue in excess of twenty-five percent for16
appropriation to the Budget Stabilization Fund.17
(b) At a minimum, fifty percent of nonrecurring revenue shall be reserved18

construction. Such appropriations shall be subject to the provisions of R.S. 48:229,1
231, and 232.2

appropriated for deposit in the Budget Stabilization Fund.9
(b) At a minimum, fifty percent of nonrecurring revenue shall be10
appropriated to the Department of Transportation and Development for highway11
construction. Such appropriations shall be subject to the provisions of R.S. 48:229,12
231, and 232.13

Present law restricts the use of revenue designated as nonrecurring for the following
purposes:
(1)At a minimum, 25% shall be appropriated for deposit in the Budget Stabilization
Fund (the Rainy Day Fund).
(2)Retiring or defeasance of bonds in advance and in addition to the existing
amortization requirements of the state.
(3)Additional payments against the unfunded accrued liability of the public retirement
systems.
(4)Funding for capital outlay projects in the comprehensive state budget.
(5)Deposit into the Wetlands Conservation and Restoration Fund.

Proposed law requires 50% of revenue designated as nonrecurring be appropriated to the
Dept. of Transportation and Development (DOTD) for highway construction. Specifies that
such appropriations shall be subject to present law governing the fixing of priorities by
DOTD and the allocation of appropriations among the several highway classifications.
