Regular Session, 2010 HOUSE BILL NO. 819 BY REPRESENTATIVE MILLS MTR VEHICLE/EMERGENCY: Changes definition of "authorized emergency vehicle" AN ACT1 To amend and reenact R.S. 32:1(1), relative to motor vehicles; to provide for certain2 personal vehicles be included in the definition of "authorized emergency vehicle";3 and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:1(1) is hereby amended and reenacted to read as follows:6 ยง1. Definitions7 When used in this Chapter, the following words and phrases have the8 meaning ascribed to them in this Section, unless the context clearly indicates a9 different meaning:10 (1) "Authorized emergency vehicle" means a vehicle of a fire department,11 a vehicle of the department's weights and standards police force, a police vehicle, a12 privately owned vehicle belonging to members of an organized volunteer fire13 department or fire district when so designated or authorized by the fire chief of that14 fire department or fire district, a privately owned vehicle equipped with emergency15 lights or sirens belonging to a peace officer or deputized parish or municipality16 employee and being used in the course and scope of his employment to respond to17 an emergency when such use is designated or authorized by the employing public18 body, an industrial-owned vehicle assigned to members of a fire department or fire19 district when so designated or authorized by the fire chief of that fire department or20 HLS 10RS-895 ENGROSSED HB NO. 819 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. fire district, a vehicle parked or stopped by elevator repair or construction personnel1 while responding to an elevator emergency, such ambulances and emergency2 medical response vehicles certified by the Department of Health and Hospitals that3 are operated by certified ambulance services, and emergency vehicles of municipal4 departments or public service corporations as are designated or authorized by the5 secretary of the Department of Transportation and Development or by the chief of6 police of any incorporated municipality. Proposed law adds a privately owned vehicle equipped with emergency lights or sirens belonging to a peace officer or deputized parish or municipality employee and being used in the course and scope of his employment to respond to an emergency when such use is designated or authorized by the employing public body to the definition of "authorized emergency vehicle".
