HOUSE CONCURRENT STUDY REQUEST NO. 3
BY REPRESENTATIVE TALBOT
INSURANCE/HEALTH-ACCID:  Requests House and Senate committees on insurance to
study the creation of an interstate compact to allow the sale of health insurance
policies across state lines
A CONCURRENT STUDY REQUEST1
To the House Committee on Insurance and the Senate Committee on Insurance to meet and2
to function as a joint committee to study the creation of an interstate compact to3
allow the sale of health insurance policies across state lines and to report the findings4
of the joint committee to the legislature prior to the convening of the 2011 Regular5
Session of the Legislature of Louisiana. 6
WHEREAS, House Bill No. 1191 of the 2010 Regular Session of the Legislature7
would have provided for creation of an interstate compact to allow the sale of health8
insurance policies across state lines; and 9
WHEREAS, the idea of such an interstate compact has been discussed by many10
parties, including the National Association of Insurance Commissioners, as an option to11
increase the availability of health insurance and increase competition among health12
insurance carriers; and 13
WHEREAS, provisions to allow for such a compact were included in many of the14
federal health care reform bills as originally drafted; and 15
WHEREAS,  legislation to provide for such a compact has been introduced in a16
number of other states, including Georgia and Washington; and 17
WHEREAS, such a compact would allow a health insurance carrier which is licensed18
in one state to sell health insurance policies in other compacting states; and 19 HLS 10RS-2228	ORIGINAL

WHEREAS, the insurance commissioners in the compacting states would agree to1
work together to regulate such health insurance carriers; and 2
WHEREAS, issues remaining to be resolved include which state law would rule, how3
the compacting states would interact with respect to complaints, and how an insolvent health4
insurance carrier would be handled.5
THEREFORE, the Legislature of Louisiana requests the House Committee on6
Insurance and the Senate Committee on Insurance to meet and to function as a joint7
committee to study the creation of an interstate compact to allow the sale of health insurance8
policies across state lines and to report the finding of the joint committee to the legislature9
prior to the convening of the 2011 Regular Session of the Legislature of Louisiana. 10
